CONDITIONS OF APPROVAL <br /> MS-00-41 <br /> Green Farms/Luis Dairy <br /> Minor Subdivision Application No. MS-00-41 was approved by the San Joaquin County Community <br /> Development Department on February 13, 2001. The effective date of approval is February 23, 2001. <br /> This tentative map approval will expire on February 23, 2004,which.is three years from the effective <br /> date of approval,unless(1)all Conditions of Approval have been complied with and (2)a Parcel Map <br /> has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified,and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact:Leanne Mueller,468-3228) <br /> a. TENTATIVE MAP: The Certificate of Compliance shall substantially conform with the approved <br /> tentative map dated January 3, 2001. <br /> b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of 330 feet, measured at the front yard setback line. <br /> (DevelopmentTitle Section 9-010.4) <br /> (2) All parcels shall have a minimum lot area of 40 acres.(DevelopmentTitle Section 9-010.2) <br /> c. CERTIFICATE OF COMPLIANCE: A Certificate of Compliance is required for all parcels. A fee is <br /> required to process the Certificate of Compliance application.(DevelopmentTitle Section 9-890.4) <br /> d. ACCESS: The following access requirements apply and shall be shown on the Certificate of <br /> Compliance: <br /> (1) A proposed minimum 25-foot-wide private easement for access to Parcel 3, along the east <br /> property line of Parcel 2, shall be shown on the Certificate of Compliance. A proposed minimum <br /> 25-foot-wide private easement for secondary access to Parcel 3, along the west property line of <br /> Parcels 1 and 2, shall be shown on the Certificate of Compliance.(DevelopmentTitle Section 9- <br /> 1150.15) <br /> (2) The following note shall be placed on the Certificate of Compliance and also shall be recorded <br /> as a separate instrument: <br /> A. At the time of development of Parcel 3, the entire length of the private right-of-way and the <br /> secondary access for Parcel 3 shall be constructed and maintained to the standards <br /> required by Section 10.207 of the Uniform Fire Code and applicable San Joaquin County <br /> Improvement Standards.(DevelopmentTitle Section 9-1150.15[c]) <br /> 2. COUNTY COUNSEL <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and <br /> employees from any claim, action, or proceeding against the local agency or its agents, officers, or <br /> Conditions of Approval - 1 - MS-0041 <br />
