CONDITIONS OF APPROVAL <br /> PA-0400255 <br /> Longstreth <br /> Minor Subdivision Application No. PA-0400255 was approved by the San Joaquin County <br /> Community Development Department on August 18, 2004. The effective date of approval is August <br /> 28, 2004. This tentative map approval will expire on August 28, 2007, which is three years from the <br /> effective date of approval, unless (1) all Conditions of Approval have been complied with and (2) a <br /> Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified,and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT(Staff Contact: Raymond Hoo, 468-3164) <br /> a. CERTIFICATE OF COMPLIANCE: A Certificate of Compliance is required for all parcels. The <br /> property descriptions submitted with the Certificate of Compliance application shall substantially <br /> conform with the approved tentative map dated May 11, 2004. Access improvement requirements <br /> shall be included on the Certificate of Compliance. A fee is required to process the Certificate of <br /> Compliance application. (Development Title Section 9-890.4) <br /> b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of 330 feet, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> (2) All parcels shall have a minimum lot area of 40 gross acres. (Development Title Section 9-310.2) <br /> c. ACCESS: The following access requirements apply and shall be included in the Certificate of <br /> Compliance property description: <br /> (1) The property description for the Certificate of Compliance shall include a minimum 25-foot wide <br /> easement for access from Sola Road to each parcel. <br /> At the time of development of any of the parcels, the entire length of the private right-of-way for <br /> the parcels, including any required secondary access, shall be constructed and maintained to <br /> the standards required by Section 10.207 of the Uniform Fire Code and applicable San Joaquin <br /> County Improvement Standards. (Development Title Section 9-1150.15[c]) <br /> 2. COUNTY COUNSEL <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and <br /> employees from any claim, action, or proceeding against the local agency or its agents, officers, or <br /> employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, <br /> appeal board, or legislative body concerning a subdivision, which action is brought within the time <br /> provided for in Section 66499.37 of the Government Code. <br /> 3.
