Surrounding the property are several parcels that are undersized thereby making them <br /> incompatible with the current zoning. The granting of this variance request will create a variation <br /> to the size of the parcel and will not cause the parcel to be any more undersized than some of the <br /> existing parcels in the area of the proposed variance." <br /> • This finding cannot be made because granting this Variance will constitute a grant of special <br /> privileges. The zone minimum for the creation of new lots is forty (40) acres. Permitting the parcel to <br /> vary the limitations of the AG-40 zone, while the surrounding properties must abide by the same <br /> limitations, constitutes special privileges. Currently, there are no limitations upon this property that <br /> are not also on the properties in the vicinity and zone. The surrounding parcels which are below zone <br /> minimum in size have been created by Minor Subdivision applications before the current <br /> Development Title was approved in 1992. The General Plan development density for parcels with the <br /> General Plan designation of General Agriculture is a maximum of one primary dwelling unit per 20 <br /> gross acres. This proposal is inconsistent with the General Plan density requirement. <br /> Finding Three: Use Authorized <br /> The Variance will not authorize a use or activity which is not otherwise expressly authorized by <br /> the regulation governing the parcel of property. <br /> Applicant's Statement: "Proposed variance is for second residence, and this area is residential <br /> allowable." <br /> • This finding can be made because the Variance application does not authorize a use that is not <br /> otherwise expressly authorized by the General Plan or Development Title. Residential uses, <br /> including second unit dwellings, are permitted in the A/G (General Agriculture) General Plan <br /> designation and in the AG-40 zone. The parcel is currently used for residential purposes. <br /> Neighborhood Opposition <br /> Staff has received one letter in opposition to the Variance application.
