7. AIR POLLUTION CONTROL (Staff Contact: Jessica Willis, 559-230-5800) a. Regulation VIII (Fugitive PM10 Prohibitions) Regulation VIII (Rules 8011 —8081)is a series of rules designed to reduce PM10 emissions (predominantly dust/dirt)generated by human activity, including construction, road construction, bulk materials storage, landfill operations, etc. If a nonresidential project is 5.0 or more acres in area, a Dust Control Plan must be submitted as specified in Section 6.3.1 of Rule 8021. If a nonresidential site is1,0 to less than 5.0 acres, an owner/operator must provide written notification to the District that at least 48 hours prior to his/her intent to begin any earth moving activities (see Section 6.4.2). A compliance assistance bulletin has been enclosed for the applicant. Rule 4101 (Visible Emissions): This rules prohibits emissions of visible air contaminants to the atmosphere and applies to any source operation that emits or may emit air contaminants. The applicant must contact the District's Small Business Assistance Office at 559-230-5888 to receive additional information/instructions. 8. DEPARTMENT OF WATER RESOURCES (Staff Contact: Christopher Huitt, 916-653-5791) a. If the project encroaches on an adopted flood control plan, the applicant will need to obtain an encroachment permit from the Reclamation Board prior to initiating any activities. The permitting process may take as much as 45 to 60 days to process. A condition of the work permit requires the securing of all the appropriate additional permits before initiating work. 9. CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD(Staff Contact: Timothy O'Brian, 916- 464-3291) a. Waste Discharge Requirements: Because waste water will be generated, stored, or disposed on the site,WDRs may be required. In accordance with California Water Code Section 13260, the project proponent is required to submit a Report of Waste Discharge(RWD) at least 150 days'prior to discharging waste water at the site. b. Construction Storm Water Permit: A National Pollutant Discharge Elimination System (NPDES) General Permit for Storm Water Discharges Associated with Construction Activities, Order No. 99- 28-DWQ, is required when a project involves clearing, grading, disturbances to the ground, such as stockpiling, or excavation. Currently, construction activity that involves soil disturbances on construction sites one acre or greater or which are part of a larger common plan of development or sale requires,a construction storm water permit. c. Because construction associated with the project will disturb more than one acre, the property owner needs to obtain permit coverage under the NPDES General Permit No. CASOOo002 for Discharges of Storm Water Associated With Construction Activity. Before construction begins, the proponent must submit a Notice of Intent(NO[)to comply with the permit to the State Water Resources Control Board, and a Storm Water Pollution Prevention Plan(SWPPP) must be prepared. The permitting requirement applies both at the excavation site and the processing facility. d. Water Quality Certification—Wetlands: If a U. S. Army Corps of Engineers(ACOE) permit is required due to the disturbance of wetlands, then Water Quality Certification must be obtained from the Regional Board prior to initiation of project activities. Section 401 of the Federal Clean Water Act requires that the project proponent for any project that impacts surface waters of the United States (such as streams and wetlands) must request a 401 Water Quality Certification from the Regional Board. Water Quality Certification must be obtained prior to initiation of project activities.
