APPLICATION - VARIANCE <br /> SAN JOAQUIN COUNTY COMMUNITY DEVELOPMENT DEPARTMENT <br /> The following findings of fact must be made by the County before a Variance can be granted. Indicate what facts In the case of this application <br /> support each of the findings. These findings that you provide will be Included with the Staff Reports that are distributed to members at the <br /> Planning Commission, <br /> 1. Because of the special circumstances appllcab4 to the property,Including size, shape, topography, location or surroundings, the <br /> strict application of the zoning regulations deprives the property of privileges enjoyed by other properties In the vicinity and under <br /> _Identical zoning classitIcatlon. <br /> Because of the size and shape of the property and project area, the requested variance <br /> best meets the needs of the property owners and of the General Plan. The project as proposed <br /> does not interfere or eliminate any land currently in an agricultural use. The project is not <br /> inconsistent with other properties in the area. <br /> 2. The granting of the Variance will not cons tltute a grant of special privileges Inconsistent with the llmitations upon other properties In <br /> the vicinity and zone In which the property Is'sltuated. <br /> The granting of this Variance will not affect or change any of the current land in the <br /> project area. The project area is non-irriagatable and not within the agricultural area of the <br /> property. Furthermore by splitting this property with a variance as proposed, the number of <br /> potential home-sites will be further limited and retention of the farmable land is assured. <br /> 3. The Variance will not authorize a use oractivity which Is not otherwise expressly authorized by the zone regulation governing the <br /> parcel of property. <br /> The variance will not change any use on the property. The granting of the variance will <br /> insure the continued use and protection of the farmable land.
