APPLICATION - VARIANCE SAN JOAQUIN COUNTY COMMUNITY DEVELOPMENT DEPARTMENT The following findings of fact must be made by the County before a Variance can be granted. Indicate what facts In the case of this application support each of the findings. These findings that you provide will be Included with the Staff Reports that are distributed to members at the Planning Commission, 1. Because of the special circumstances appllcab4 to the property,Including size, shape, topography, location or surroundings, the strict application of the zoning regulations deprives the property of privileges enjoyed by other properties In the vicinity and under _Identical zoning classitIcatlon. Because of the size and shape of the property and project area, the requested variance best meets the needs of the property owners and of the General Plan. The project as proposed does not interfere or eliminate any land currently in an agricultural use. The project is not inconsistent with other properties in the area. 2. The granting of the Variance will not cons tltute a grant of special privileges Inconsistent with the llmitations upon other properties In the vicinity and zone In which the property Is'sltuated. The granting of this Variance will not affect or change any of the current land in the project area. The project area is non-irriagatable and not within the agricultural area of the property. Furthermore by splitting this property with a variance as proposed, the number of potential home-sites will be further limited and retention of the farmable land is assured. 3. The Variance will not authorize a use oractivity which Is not otherwise expressly authorized by the zone regulation governing the parcel of property. The variance will not change any use on the property. The granting of the variance will insure the continued use and protection of the farmable land. The granting of this variance will not decrease the amount of farmable land in the project area.
