Analysis <br /> Background <br /> This item, which would normally be processed at staff level, is being referred to the Planning Commission <br /> due to neighborhood opposition. A petition of opposition with 25 signatures and five letters in opposition <br /> were received. Issues raised in those letters include aesthetics and radio frequency emissions. <br /> Aesthetics <br /> Three methods are currently used to mitigate the aesthetic impacts associated with towers. The height <br /> of the tower may be reduced, the tower may be camouflaged, and the tower may provide for colocation. <br /> The applicant has indicated that the proposed height is required to facilitate 4 microwave dishes and the <br /> cellular antenna, and no practical method for camouflage is available. However, the tower will provide for <br /> colocation. <br /> Radio Frequency (RF) Emissions <br /> FCC regulations preempt the County from basing regulation of the placement of personal wireless facilities <br /> on the environmental effects of RF emissions. Section 704 of the 1996 Telecommunications Act states <br /> that 'No State or local government or instrumentality thereof may regulate the placement, construction, <br /> and modification of personal wireless service facilities on the basis of the environmental effects of radio <br /> frequency emissions to the extent that such facilities comply with the Commission's regulations <br /> concerning such emissions."
