CONDITIONS OF APPROVAL <br /> MS-97-12 <br /> Buettner <br /> Minor Subdivision Application No. MS-97-12 was approved by the San Joaquin County <br /> Community Development Department on November 3, 1997. The effective date of approval is <br /> November 13, 1997. This tentative map approval will expire on November 12, 2000, which is three <br /> years from the effective date of approval, unless (1) all Conditions of Approval have been <br /> complied with and (2) a Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified,. all Conditions of Approval and Ordinance requirements shall be <br /> fulfilled prior to approval of the Parcel Map. Those Conditions followed by a Section Number <br /> have been identified as Ordinance requirements pertinent to this application. Ordinance <br /> requirements cannot be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Chandler Martin, 468-3190) <br /> a. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) Both parcels shall have a minimum lot width of 330 feet. (Development Title Section <br /> 9-610.4) <br /> (2) Both parcels shall have a minimum lot area of 40 acres. (Development Title Section <br /> 9-610.2) <br /> b. ACCESS: The following access requirements apply and shall be included in the property <br /> description for the Certificate of Compliance: <br /> (1) A 25-foot-wide private easement for access to Parcel 2, from Sola Road, shall be <br /> included in the property description for the required Certificate of Compliance. In <br /> addition, a 25-foot-wide private easement for secondary access to Parcel 2, from <br /> Farmington Road, shall be included in the property description for the required <br /> Certificate of Compliance. (Development Title Section 9-1150.15) <br /> (2) The following note shall be included on the Certificate of Compliance and also shall <br /> be recorded as a separate instrument: <br /> A. At the time of development of Parcel 2, the entire length of the private right- <br /> of-way for Parcel 2, including any required secondary access, shall be <br /> constructed and maintained to the standards required by Section 10.207 of <br /> the Uniform Fire Code and applicable San Joaquin County Improvement <br /> Standards. (Development Title Section 9-1150.15(c]) <br /> 2. DEPARTMENT OF PUBLIC WORKS: (See the attached memo dated June 19, 1997.) <br /> 3. PUBLIC HEALTH SERVICES: (See the attached memo dated June 5, 1997.) <br /> 4. COUNTY COUNSEL: <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, <br /> the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, <br /> officers, and employees from any claim, action, or proceeding against the local agency or its <br /> agents, officers, or employees to attack, set aside, void, or annul an approval of the local <br /> agency, advisory agency, appeal board, or legislative body concerning a subdivision, which <br /> action is brought within the time provided for in Section 66499.37 of the Government Code. <br />
