h. A retention pond shall be provided to meet the requirements of the County and to provide <br /> adequate drainage for the subdivision. An easement for the retention pond shall be <br /> provided on the Designated Remainder. (Development Title Section 9-1135.3) <br /> i. The parcels shall drain into a drainage system when it becomes available(within 200 feet) <br /> and shall annex to the Special District or County Service Area maintaining the system. <br /> This requirement shall be noticed by a statement on the Parcel Map. (Development Title <br /> Section 9-1135.3(a)) <br /> j. The subdivider shall execute a Deferred Storm Drainage Facility Agreement based on the <br /> Storm Drainage Master Plan (Linden, south of State Route 26) to finance their <br /> proportionate share of the estimated cost of the storm drainage system. A$260.00 fee <br /> currently is required for processing, per Development Title Table 9-240.2, in addition to <br /> a copy of the Grant Deed, legal descriptions of Parcels 1 and 2, and an estimate ofthe <br /> proportionate share. The estimate and legal descriptions shall be prepared by a <br /> Registered Civil Engineer and submitted to the Department of Public Works for approval. <br /> As an option, Public Works will prepare the estimate for an additional fee of $115.00. <br /> (Development Title Section 9-1135.3 and Ordinance Code Section 10-6006) <br /> k. Street lighting shall be provided for the subdivision along the entrance street and at the <br /> intersection of State Route 26. Annexation to the Linden Street Lighting District will be <br /> required for maintenance and operation of the street lights. (Development Title Section <br /> 9-1150.11) <br /> 1. All traffic signs and markings shall conform to the Manual on Uniform Traffic Control <br /> Devices and San .Joaquin County Standards and shall be shown on the improvement <br /> plans. A traffic circulation plan shall be submitted for the area bounded by State Route 26 and <br /> the west, south, and east lines of APN 105-170-13. <br /> 3. COUNTY COUNSEL: <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, <br /> the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, <br /> officers, and employees from any claim,action, or proceeding against the local agency <br /> or its agents, officers, or employees to attack, set aside,void, or annul an approval of the <br /> local agency, advisory agency, appeal board, or legislative body concerning a <br /> subdivision, which action is brought within the time provided for in Section 66499.37 of <br /> the Government Code. <br /> Conditions of Approval - 2 - MS-96-37 <br />
