1 (2) Any lighting shall be designed to confine direct rays to the premises. No spillover beyond the property lines shall be permitted except onto public thoroughfares, provided, however, that such light shall not cause a hazard to motorists. (Development Title Section 9-1015.5(g)(4)) f. LANDSCAPING: Landscaping shall be provided and comply with the following: (1) A minimum 10-foot-wide landscaped strip, respecting the ultimate right-of-way width of State Route 26, shall be installed across the frontage of the project site. g. FIREWALLS: Exterior walls less than 20 feet from a property line shall be constructed of one-hour fire resistive material. 2. DEPARTMENT OF PUBLIC WORKS: (Staff Contact: Tom Iwamiya, 468-3023) a. Any dedications, improvements, or permits for State Route 26 shall be as required by Caltrans. b. The Traffic Impact Mitigation Fee will be required for this development. The fee is due and payable at the time of building permit application. The fee currently is$3,081.00 per 1,000 gross square feet of building designated as Retail Service in the Linden area. The fee shall be automatically adjusted July 1 of each year by the Engineering Construction Cost Index as published by the Engineering News Record. Contact the Public Facilities Division of the Department of Public Works (209-4683055) for any alternate method of payment allowed for expansions/phasing. (Resolutions R-90-304, R-91-1025, R-93-167, R-94-174, and R-95-650) C. The Water Supply Facilities Impact Mitigation Fee will be required for this development. The fee is due and payable prior to issuance of the building permit. The fee currently is $333.00 per 1,000 gross square feet of building designated as Retail Service. The fee shall be automatically increased on January 1 of each year through the year 2005 at the rate of 7.66 percent. (Development Title Section 9-818.4 and Resolution R-91-327) 3. PUBLIC HEALTH SERVICES: (Staff Contact: Jeff Carruesco, 468-3438) a Submit three sets of food facility construction plans to the Environmental Health Division for review and approval prior to issuance of building permits. (California Health and Safety Code Section 27550) b. Submit four sets of detailed underground storage tank plans to the Environmental Health Division for review and approval prior to the beginning of construction. C. The car wash water shall either be sent through a self-contained water recycling system or plumbed into the Linden County Water District. 4. AIR POLLUTION CONTROL DISTRICT: (Staff Contact: Tracy Roemer, 545-7000) a. An Authority to Construct (ATC)and Permit to Operate(PTO)will be required for this type of use. The applicant is advised to contact the Permit Services Division to obtain appropriate approvals prior to construction.
