Item No. 2 <br /> PC: 6-4-92 <br /> MS-92-78 <br /> Page 3 <br /> STAFF ANALYSIS <br /> BACKGROUND: <br /> The 28.86-acre parcel is owned by Edward Marugliano, who resides on the property directly to the east. <br /> He is applying for the family member homesite parcel for his daughter and son-in-law, Frank and Carol <br /> Reyes. Mr. Marugliano leases approximately 72 acres of agricultural property to the Reyes, including the <br /> 28.86-acre parcel in this application. <br /> According to the Reyes' accountant, the Reyes earn a substantial portion of their income from farming <br /> sources, which include the walnut and cherry crops and income from their walnut huller. <br /> The 28 acres is under Williamson Act Contract, which requires a minimum of 10 acres for family-member <br /> homesite parcels and a Joint Management Agreement to link the original parcel and the family-member <br /> homesite parcel. <br /> In his response to the application referral, Mr. John Eilers stated that he opposes this proposed division <br /> of land. Mr. Eilers believes this subdivision violates the provisions of the Williamson Act Contract (see <br /> attached letter). He indicated in his letter that he would support the construction of a home on this <br /> property if the property was removed from the Williamson Act Contract or if the owners built a home <br /> without subdividing. Because of this opposition, the Minor Subdivision application is being referred to the <br /> Planning Commission. <br /> POLICY CONSIDERATIONS: <br /> Ordinance: <br /> There are six requirements to Section 9-4010.2(b) that must be met. <br /> 1. The homesite parcel must contain a minimum of 11/2 acres. <br /> • The proposal is for a 10-acre homesite. <br /> 2. The original parcel must be at least 20 acres. <br /> • The original parcel is 28.86 acres. <br /> 3. The purpose of the subdivision is to finance a residence for the family member. <br /> • The applicant has stated that he is going to finance a residence for Frank and <br /> Carol Reyes. <br />
