Date: April 27,2005 Re: Lead Agency Project Title: N/A Lead Agency Project Number: PA-0500232(MS) Assessor Parcel Number(s): 255-320-01 Total Acres to be converted from Open Space Use: 5 acres Habitat Types to be Disturbed: Agriculture Land Species Impact Findings: Findings to be determined by SJMSCP biologist. Dear Ms. Allen: SJCOG, Inc. has reviewed applications PA- 0500232 (MS) this project involves a minor subdivision application to create a home site parcel from an existing 243.92 acre parcel. Parcel One(1)to contain 5 acres, and designated remainder to contain 238.92 acres. This project is located on the southwest corner of State Rote 33 and State Route 5, southeast of Tracy. San Joaquin County is a signatory to San Joaquin County Multi-Species Habitat Conservation and Open Space Plan (SJMSCP). Participation in the SJMSCP satisfies requirements of both the state and federal endangered species acts, and ensures that the impacts are mitigated below a level of significance in compliance with the California Environmental Quality Act (CEQA). Although participation in the SJMSCP is voluntary, lead agents should be aware that if project applicants choose against participating in the SJMSCP, they will be required to provide alternative mitigation in an amount and kind equal to that provided in the SJMSCP. Any future structure(s) may require the conversion of Agriculture habitat and as such should condition the project applicant(s)to participate in the SJMSCP. Prior to receiving building permit a SJMSCP biological survey must be completed and coverage must be granted. The project is located within the unmapped land use areas and as per the requirements of the SJMSCP those projects are subject to case-by-case review by the Habitat Technical Advisory Committee (TAC) prior to participation.
