Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> I. Approve the Negative Declaration; <br /> 2. Forward Williamson Act Contract Cancellation Application No. PA-0900263 to the Board of <br /> Supervisors with a recommendation of approval, with the Conditions and Contingencies <br /> contained in the staff report, based on the ability to make the required Findings for Williamson <br /> Act Contract Cancellation; and <br /> 3. Forward Site Approval application No. PA-0900264,along with the Conditions of Approval,to the <br /> Board of Supervisors with a recommendation of approval based on the ability to make the <br /> required Findings for a Site Approval. <br /> Findings for PA-0900263 (Williamson Act Contract Cancellation) <br /> Finding (a) <br /> Sub-Finding 1 <br /> The cancellation is for land on which a Notice of Nonrenewal has been served pursuant to Section 51245 <br /> of the Government Code; <br /> This sub-finding can be made because the applicant filed a Notice of Non-Renewal on October 23, <br /> 2009. The application was approved on October 23, 2009. <br /> Sub-Finding 2 <br /> The cancellation is not likely to result in the removal of adjacent lands from agricultural use; <br /> This sub-finding can be made because no area would be taken out of agriculture_ The 1.2-acre <br /> project area contains a residence, swimming pool,and driveway. No other land would be needed <br /> for the bed and breakfast.Approval of the cancellation will not interfere with or alter the current <br /> uses on the subject parcel or on adjacent properties. Therefore,the cancellation is not likely to <br /> result in the removal of adjacent lands from agricultural use. <br /> Sub-Finding_3 <br /> The cancellation is for an alternative use which is consistent with the applicable provisions of the County <br /> General Plan; <br /> This sub-finding can be made because the underlying project is a Site Approval application for a <br /> bed and breakfast inn. The General Plan designation for the project area is General Agriculture <br /> (AIG) and the property is zoned General Agriculture, 40-acre minimum (AG-40). AG-40 is an <br /> implementing zone of the A/G designation. A bed and breakfast inn (Use Type; Lodging Services- <br /> Bed and Breakfast) may be conditionally permitted in the AG40 zone with an approved Site <br /> Approval.A bed and breakfast may only be approved if there is an existing residence and the land <br /> is not under a Williamson Act contract. <br /> San Joaquin County PA-0900263, PA-09002641Raverty <br /> Community Development Page 7 <br />
