Farm Bureau <br /> The Farm Bureau was mailed a project referral on October 30, 2009. They responded in.a memo datedA <br /> F December 23, 2009.�Zeveral concerns were brought up in the memo. Many of the issues are clarified in <br /> the project descriptio, and the background sections., <br /> 1. The County planning staff failed to mail off a required notice to the Department of Conservation <br /> (DOC). <br /> A referral was mailed to the DOC on October 30, 2009, along with the other referrals. A second <br /> notice was delivered to the DOC on December 19, 2009.The DOC has not responded. <br /> 2. In order for the County to approve this permit, the applicant needed to install one acre of wine grapes in <br /> order to make the:findings to allow a use permit that would be compliant with the Williamson Act. <br /> 11 <br /> The one acre of gripes is a Community Development Department policy requirement for off-site <br /> wine cellars, not a requirement for Williamson Act compliance. Since a winery was approved, the <br /> wine cellartwine tasting room is now considered on-site and part of the winery. Wine grapes are not <br /> required for a winery. One acre of grapes has been planted on a portion of the parcel that is not part <br /> of these two permits. <br /> 3. Can the County':approve a restaurant, commercial store, and a wedding suite as: a public use on <br /> Williamson Act lands? <br /> Restaurants (Use Type: Eating Establishments, Convenience or Full-service) and Boutiques (Use <br /> Type: Retail Sales and Service) are not permitted on land zoned AG-40, even if the property is not <br /> under a Williamson Act Contract. The Community Development Department has not issued a permit <br /> for a restaurant or boutique or a permit for weddings. The applicant currently has approved permits <br /> for a wine cellar and a winery. The approval includes 24 marketing events for up to 150 people, No <br /> permits have been._xissued for a wedding suite or wedding office. Further, the application is to <br /> remove land from the Williamson Act Contract and not for development of lands covered by a <br /> Williamson Act Contfact. <br /> Site Approval PA-0900264(Bed and Breakfast) <br /> The Site Approval application cannot be approved unless the Williamson Act Cancellation application is <br /> approved because a hbed and breakfast inn (Use Type: Lodging Services) is not permitted by <br /> Development Title ordinance on land under Williamson Act contract(Lodging Services is not listed as a <br /> specified use in Development Title Section 9-1810.3[b]). A <br /> If both projects are approved, then a building permit to change the occupancy of the residence will be <br /> required as a Condition of Approval.
