4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be
injurious to the property or improvements of adjacent properties.
• This finding can be made because the Initial Study prepared for this project found no
potentially significant environmental impacts. Mitigation measures from the noise study
conducted by J.C. Brennan and Associates dated August 2, 2012 will be incorporated into
Conditions of Approval to ensure any impacts to noise are less than significant. With
these mitigation measures, the Initial Study concluded that the project would not have a
significant impact on the environment. As Conditions of Approval, the project must meet
the noise ordinance requirements of 65 dB at the property line and have no more than 150
attendees at each marketing event.
5. The use is compatible with adjoining land uses.
• This finding can be made because the proposed use will not interfere with nor alter the
current land uses on adjacent properties. The properties surrounding the project site are
zoned AG-40 and are being used for agricultural purposes with scattered residences. The
nearest residence is located 115 feet away from the project site on the parcel to the south.
As an ordinance requirement, marketing events shall end by 10:00 p.m.
San Joaquin County PA-1200063/St. Jorge Winery
Community Development Page 8
