7 <br /> vineyard serves as a backdrop for "weddings, banquets, or small gatherings, anniversary <br /> parties, birthday celebrations, receptions, luncheons and social affairs, both formal and <br /> casual'as already advertised and conducted by the Vierras at their St. Jorge Winery. <br /> Land use activities not properly allowed under the San Joaquin County Code are <br /> not consistent with County's General Plan. <br /> B. 4. Reason#4 Why Finding 1 Is Wrong: The Proposed Project Is <br /> "Incompatible with the Ambiance of an Agricultural Area and the <br /> Production of Wine" <br /> The Code's intent is that its regulations for Wineries and Related Facilities are <br /> "designed to help the wine industry thrive ... while simultaneously discouraging or <br /> inhibiting on-going uses that would degrade or that would be incompatible with the <br /> ambiance of an agricultural area and the production of wine." The Winery's so-called <br /> "wine garden" is nothing of the sort, but rather is an "amphitheater" (and advertised as <br /> exactly that), designed, built and advertised for "summer concerts." This already- <br /> conducted activity, now proposed to be legitimized, is "incompatible with the ambiance of <br /> an agricultural area and the production of wine." <br /> If a proposed land use activity is not properly allowed under the San Joaquin <br /> County Code, then it is not consistent with "goals, policies, standards," etc. of County's <br /> General Plan. <br /> C. Finding 4 is Wrong <br /> C. 1. Finding 4 Reads: <br /> "4. Issuance of the permit will not be significantly detrimental to the public <br /> health, safety, or welfare, or be injurious to the property or improvements of <br /> adjacent properties. <br /> • This finding can be made because the Initial Study prepared for this <br /> project found no potentially significant environmental impacts. <br /> Mitigation measures from the noise study conducted by J.C. Brennan <br /> and Associates dated August 2, 2012 will be incorporated into <br /> Conditions of Approval to ensure any impacts to noise are less than <br /> significant. With these mitigation measures, the Initial Study <br /> concluded that the project would not have a significant impact on the <br /> environment. As Conditions of Approval, the project must meet the <br /> noise ordinance requirements of 65 dB at the property line and have no <br /> more than 150 attendees at each marketing event." <br />
