Reason# 1 Why the"Noise" Condition Should Be Modified or <br /> Removed: <br /> Even if all the mitigation and other project conditions of approval were met, the <br /> Isolas and their neighbors have been and will continue to be heavily impacted due to their <br /> legally existing and conforming proximity to the out-of-character proposed project. This <br /> includes the nature of sound-carrying qualities in rural areas and other such factors which <br /> will not be properly mitigated. <br /> E. 2. Reason # 2 Why the "Noise" Condition Should Be Modified or <br /> Removed: The Proper Measurement Should Be Setback, Not Property <br /> Line <br /> Once again, the noise, the light and glare, the traffic, the inability to have "quiet <br /> enjoyment" or simply go to sleep in one's own home, and all the impacts necessarily <br /> associated with this proposed project will necessarily aggregate on the Isolas property most <br /> immediately, and then to the other nearby neighbors. These impacts should properly be <br /> measured on the various neighbors'properties where they take on reality in peoples'lives, <br /> not merely at the Vierras' property line where they begin. <br /> F. Reasons Why All Conditions Appealed Should Be Modified or Removed: <br /> Applicant's Pattern of Disregard <br /> In light of the applicants' record of violations, the total lack of any meaningful <br /> enforcement, and all else that has transpired, the Isolas request that the Board of <br /> Supervisors direct the Community Development Department enforcement staff to fully <br /> investigate the following: <br /> 1) All"Conditions of Approval"for the St. Jorge Winery permit number PA- <br /> 0500306, issued on or about July 22,2005; <br /> 2) All requirements for that permit which were related in the June 16, 2005 <br /> letter from SJCOG, Inc., to Gillian Hayes of the San Joaquin County <br /> Community Development Department;and, <br />
