la
Site. Maximum noise levels due to live events should be monitored
at the control site(Site Z in this report), and should be limited to less
than 75 dBA Lmax.
(2) The winery staff is trained on how to use the sound level meter, sue
the proper settings on the meter and the meter is calibrated prior to
events. The sound level meter shall comply with an ANSI Type 1 or
Type 2 certification."
E. 1. Reason# 1 Why the"Noise" Condition Should Be Modified or
Removed:
Even if all the mitigation and other project conditions of approval were met, the
Isolas and their neighbors have been and will continue to be heavily impacted due to their
legally existing and conforming proximity to the out-of-character proposed project. This
includes the nature of sound-carrying qualities in rural areas and other such factors which
will not be properly mitigated.
E. 2. Reason # 2 Why the "Noise" Condition Should Be Modified or
Removed: The Proper Measurement Should Be Setback, Not Property
Line
Once again, the noise, the light and glare, the traffic, the inability to have "quiet
enjoyment" or simply go to sleep in one's own home, and all the impacts necessarily
associated with this proposed project will necessarily aggregate on the Isolas property most
immediately, and then to the other nearby neighbors. These impacts should properly be
measured on the various neighbors'properties where they take on reality in peoples'lives,
not merely at the Vierras' property line where they begin.
F. Reasons Why All Conditions Appealed Should Be Modified or Removed:
Applicant's Pattern of Disregard
In light of the applicants' record of violations, the total lack of any meaningful
enforcement, and all else that has transpired, the Isolas request that the Board of
Supervisors direct the Community Development Department enforcement staff to fully
investigate the following:
1) All"Conditions of Approval"for the St. Jorge Winery permit number PA-
0500306, issued on or about July 22,2005;
2) All requirements for that permit which were related in the June 16, 2005
letter from SJCOG, Inc., to Gillian Hayes of the San Joaquin County
Community Development Department;and,
