CONDITIONS OF APPROVAL PA-04-139 Weisz Minor Subdivision Application No. PA-04-139 was approved by the San Joaquin County Community Development Department on May 12, 2004. The effective date of approval is May 22, 2004. This tentative map approval will expire on May 22, 2007, which is three years from the effective date of approval, unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has been filed with and accepted by the County Surveyor. Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot be modified, and other Ordinance requirements may apply. 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Jose Rubianes, 953-7509) a. TENTATIVE MAP: The Parcel Map shall substantially conform with the approved Tentative Map dated March 19, 2004. b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: (1) All parcels shall have a minimum lot width of sixty (60) feet measured twenty (20) feet back from the front property line (Development Title Section 9-310.4) (2) All parcels shall have a minimum lot area of six thousand (6,000) square feet. (Development Title Section 9-310.3) c. UNIFORM FIRE CODE: The following Uniform Fire Code and San Joaquin County Ordinance Code requirements will be applicable and shall be incorporated in the construction plans before submittal to the Community Development Department for a building permit (Staff Contact: Steve Dalton, 468- 2229. (1) Fire flow and hydrants will be provided for the proposed project by use of Appendix III-A and III-B of the California Fire Code. (2) One fire hydrant must be installed at a location chosen by the Montezuma Fire District. 2. COUNTY COUNSEL a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and employees from any claim, action, or proceeding against the local agency or its agents, officers, or employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, appeal board, or legislative body concerning a subdivision, which action is brought within the time provided for in Section 66499.37 of the Government Code. 3.
