P <br /> 304 East Weber Avenue, Third Floor • Stockton, CA 95202 <br /> 209/468-3420 <br /> MEMO <br /> Date: SEPTEMBER 20, 2001 <br /> TO: SAN JOAQUIN COUNTY <br /> COMMUNITY DEVELOPMENT DEPARTMENT <br /> ATTN: LEANNE MUELLER <br /> FROM: PUBLIC HEALTH SERVICES <br /> ENVIRONMENTAL HEALTH DIVISION <br /> MIKE HUGGINS, SUPERVISING R.E.H.S., R.D.I. <br /> RE: SA-01-52 (APPEAL) <br /> 13436 NORTH THORNTON ROAD, LODI <br /> The San Joaquin County Environmental Health Division has the following response to the above <br /> referenced appeal: <br /> On August 3, 2001, Mike Huggins, Supervising R.E.H.S., R.D.I., and Raymond Borges, Lead <br /> Senior R.E.H.S., R.D.I. met with Mike Hakeem, Attorney, and Steve Coldani, neighboring <br /> project owner at the office of the Environmental Health Division (EHD). <br /> ISSUE 1: <br /> The issue related to the 40-foot easement and placement of pipe in that easement by the Lima <br /> Ranch is not something the EHD has authority to correct. The parties were instructed to meet <br /> with Lima Ranch and seek a civil remedy to the issue. In regards to crossing the easement with <br /> manure liquid or solid, it will be the responsibility of the Lima Ranch to access the southern <br /> properties without violating the easement. It appeared to the EHD that alternative access is <br /> available down on Thornton Road to the south of the dairy facility. <br /> ISSUE 2: <br /> The Manure Management Plan will be required to recognize the separation of the property <br /> concerning liquid or solid manure. For many years the EHD has required dairymen in San <br /> Joaquin County to create a Manure/Waste Management Plan as part of upgrading an existing <br /> facility or constructing a new one. This activity is taken on jointly with the Regional Water <br /> Quality Control Board (RWQCB). It shall be noted that it is not the EHD that has primary <br /> regulatory authority for manure disposal. Under the Porter-Cologne Water Quality Control Act, <br /> it is the State Department of Water Resources through the RWQCB that has the enforcement <br /> responsibility for waste generated by dairies and protection of water ways. <br /> A Division of San Joaquin County Health Care Services Film <br /> Page 1 of 2 <br />
