WHEREAS,the Final EIR outlined various mitigation measures that would substantially <br /> lessen or avoid the Projecfs significant effects on the environment, as well as alternatives to the <br /> project as proposed which would provide some environmental advantages;and <br /> WHEREAS,the County is required,pursuant to CEQA,to adopt all feasible mitigation <br /> measures or feasible project alternatives that can substantially lessen or avoid any significant <br /> environmental effects of a proposed project; and <br /> WHEREAS,Public Resources Code section 21081, subdivision(a),requires a public <br /> agency,before approving a project for which an EIR has been prepared and certified,to adopt <br /> findings specifying whether mitigation measures and, in some instances, alternatives discussed in <br /> the EIR,have been adopted or rejected as infeasible; and <br /> WHEREAS,Exhibit A to this Resolution is a set of Findings of Fact prepared in order to <br /> satisfy the requirements of Public Resources Code section 21081, subdivision(a);and <br /> WHEREAS,as the Findings of Fact explain, the Board of Supervisors, reflecting the <br /> advice of County staff and the Planning Commission, has expressed its intention to approve the <br /> proposed Project;and <br /> WHEREAS,in taking this course, the Board of Supervisors has acted consistent with the <br /> CEQA mandate to look to project mitigation measures and/or alternatives as a means of <br /> substantially lessening or avoiding the environmental effects of the Project as proposed; and <br /> WHEREAS,all but two significant and potentially significant environmental effects <br /> associated with the Project, as approved,can be mitigated to a less than significant level through <br /> the inclusion of mitigation measures proposed in the Final EIR; and <br /> WHEREAS, the Board, in approving the Project as proposed, intends to adopt all <br /> mitigation measures set forth in the Findings of Fact; and <br /> WHEREAS, those significant effects that cannot be mitigated to a less than significant <br /> level by the adoption of feasible mitigation measures will necessarily remain,significant and <br /> unavoidable; and <br /> WHEREAS, the Board has determined, for the reasons set forth in the Findings of Fact, <br /> none of the alternatives addressed in the Final EIR would be both feasible and environmentally <br /> superior to the Project with respect to the two significant unavoidable effects of the Project; and <br /> WHEREAS, Public Resources Code section 21081, subdivision (b), and CEQA <br /> Guidelines section 15093 requires the agency to adopt a "Statement of Overriding <br /> Considerations" before approving a project with significant unavoidable environmental effects; <br /> and <br /> WHEREAS, the Board desires, in accordance with CEQA, to declare that, despite the <br /> occurrence of significant unavoidable environmental effects associated with the Project as <br /> 2 <br />
