1 � <br /> State Clearinghouse in the Office of Planning and Research was responsible for distributing <br /> environmental documents to State agencies, departments, boards, and commissions for review <br /> and comment. The County followed required procedures with regard to distribution of the <br /> appropriate notices and environmental documents to the State Clearinghouse. The State <br /> Clearinghouse was obligated to make, and did make, that information available to interested <br /> agencies for review and comment. The NOP was received by the State Clearinghouse (SCH <br /> #2006112097)and a 30 day public review period started on May 31, 2012 and ended on June 29, <br /> 2012. The NOP and all comments received on the NOP are presented in Appendix A of the Draft <br /> EIR (DEIR, p. 1-6.) <br /> Consistent with the requirements of the San Joaquin Superior Court's April 9, 2012,judgment <br /> and writ,the EIR includes an analysis of the following issue areas: <br /> • Transportation; <br /> • Air Quality; <br /> • Cumulative Impacts (Transportation <br /> and Air Quality); and <br /> • Alternatives. <br /> The County published the Draft EIR for public and agency review on September 28, 2012. A <br /> public review period of 45 days was provided on the DEIR and ended on November 13, 2012. <br /> (DEIR Notice of Availability, p. 2.) This period satisfied the requirement for a 45-day public <br /> review period as set forth in Section 15105 of the CEQA Guidelines. Three letters commenting <br /> on the DEIR were received and upon review by County Staff, it was determined that none of the <br /> comments provided any basis to identify any new significant impacts or significant information <br /> that would require recirculation of the DEIR. The proposed Final EIR was issued on December <br /> 5,2012. <br /> On December 20, 2012, the Planning Commission held a hearing at which the Commission <br /> certified the final EIR, adopted CEQA Findings of Fact and a Mitigation Monitoring and <br /> Reporting Program, and approved the proposed Project. An appeal of the Planning <br /> Commission's certification of the Final EIR was timely entered on behalf of Pilot-Flying J, Inc. <br /> The County set the appeal for hearing before the County Board of Supervisors on February 12, <br /> 2013. <br /> IV. <br /> RECORD OF PROCEEDINGS <br /> In accordance with Public Resources Code section 21167.6, subdivision (e), the record of <br /> proceedings for the County's decision on the Project includes the following documents: <br /> • The certified record of proceedings in Pilot Travel Centers, LLC v. County of San <br /> Joaquin(San Joaquin County Superior Court Case No. Case No. 39-2011-00267768-CU- <br /> WM-STK); <br /> • The NOP and all other public notices issued by the County in conjunction with the <br /> Project; <br /> Love's Travel Stops Project 6 Findings of Fact and <br /> Statement of Overriding Considerations <br />
