Approve the Negative Declaration and instruct the Clerk to <br /> file a Notice of Determination. <br /> 2 . Approve Use Permit No . UP-88-18 based on the "Findings" <br /> listed below and subject to the attached "Conditions of <br /> Approval . " <br /> FINDINGS <br /> 1 . "The establishment , maintenance, and operation of the use <br /> does not conflict with the General Plan. " <br /> ° Staff can make this finding because the operation of a dog <br /> kennel is not in conflict with the General Plan policies <br /> and has been historically allowed in areas designated as <br /> Agriculture on the Land Use/Circulation Element Map. <br /> 2 . "Adequate utilities, access roads, sanitation, drainage, and <br /> other necessary facilities have been provided, and the pro- <br /> posed improvements are properly related to existing and pro- <br /> posed streets and highways . " <br /> ° Staff can make this finding because the site plan submitted <br /> with the Use Permit application adequately demonstrates <br /> that the necessary utilities and facilities will be pro- <br /> vided. <br /> 3 . "The property involved is of adequate size and shape to <br /> accommodate the proposed use and all yards, building <br /> coverage, setbacks, parking areas, and other requirements of <br /> this Title . " <br /> ° Staff can make this finding because conditions placed on <br /> the Use Permit will ensure compliance with all Code <br /> requirements , and the site plan adequately demonstrates <br /> that these aspects have been met . <br /> 4 . "Issuance of the permit will not be significantly detrimental <br /> to the public health, safety, or welfare or be injurious to <br /> the property or improvements of adjacent properties. " <br /> Staff can make this finding because the Use Permit as sub- <br /> mitted along with the recommended Conditions of Approval <br /> and the requirements of the Local Health District will <br /> ensure proper operation of the dog kennel . <br />
