UP-88-18 OF WILLIAM & MARIA BARRY (SUPERVISORIAL <br /> DISTRICT 4) <br /> ---------------------------------------------------------------- <br /> RECOMMENDATION: <br /> Staff recommends that the Planning Commission: <br /> 1 . Approve the Revision of Approved Actions for UP-88-18 based <br /> on the Findings listed in the attached staff report . The <br /> Conditions of Approval would remain unchanged with the excep- <br /> tion of 3 (c) ; and <br /> 2 . Reconfirm the Negative Declaration prepared for UP-88-18 . <br /> BACKGROUND: <br /> On April 7 , 1988, the Planning Commission approved Use Permit <br /> Application No . Up-88-18 of William and Maria Barry to permit a <br /> private dog kennel for a maximum of 15 adult dogs. The appli- <br /> cants recently submitted a Revision of Approved Actions applica- <br /> tion on August 16, 1988 , in order to relocate the proposed kennel <br /> from the existing barn to a location on the western side of the <br /> property. <br /> Under the original approval , the existing barn was to be modified <br /> to house the dogs. When the applicants had the barn inspected, <br /> they learned that converting the existing barn would be more <br /> costly than installing a new modular barn. The proposed struc- <br /> ture would be located 60 feet south of Tokay Colony Road and 170 <br /> feet east of the western property line. The prefabricated struc- <br /> ture would consist of 9 kennels, 6 feet by 18 feet , on a concrete <br /> pad. The kennel runs would be enclosed with six-foot-high chain <br /> link. <br /> At the Planning Commission hearing of April 7 , 1988 , the main <br /> concern voiced by the neighborhood opposition was noise . Noise <br /> from barking dogs should be less of a problem with the proposed <br /> location, since the kennel will be farther away from existing <br /> residences. In addition, the applicant is proposing to restrict <br /> the dogs ' sight of Tokay Colony Road by installing a six-foot-high <br /> privacy fence to the northeast of the kennels. <br />
