CONDITIONS OF APPROVAL <br /> PA-1500242 (MS) <br /> M & P LAND COMPANYIWONG ENGINEERS, INC <br /> Minor Subdivision application no. PA-1500242 was approved by the San Joaquin County <br /> Community Development Department on November 23, 2016. The effective date of approval is <br /> November 30, 2016. This tentative map approval will expire on December 3, 2019, which is three <br /> _(3) yea rs--from-the-effective-date-of-approvalrun less-(l)-all-Coedd itions-of-Approval-have-been <br /> complied with and (2) a Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as ordinance requirements pertinent to this application. Ordinance requirements cannot be <br /> modified and other ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Stephanie Stowers [209]468-9653) <br /> a. CERTIFICATE OF COMPLIANCE: A Certificate of Compliance is required for all parcels. The <br /> property descriptions submitted with the Certificate of Compliance application shall substantially <br /> conform with the approved tentative map dated March 21, 2016. A fee is required to process the <br /> Certificate of Compliance application. (Development Title Section 9-890.4) <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note shall <br /> be recorded as a Notice of Minor Subdivision Restriction with the Certificate of Compliance: <br /> 1. All persons purchasing parcels within-the boundaries of this approved map should be <br /> prepared to accept the inconveniences or discomforts associated with agricultural <br /> operations-or-activities, such as noise, odors, insects, dust or fumes. San Joaquin <br /> County has determined that such inconveniences or discomforts shall not be <br /> considered to be a nuisance. <br /> c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this Certificate of <br /> Compliance: <br /> 1. All parcels shall have a minimum lot area of 80 acres. (Development Title Section 9-610.2) <br /> d. RIPARIAN HABITAT: Parallel to the Grant Line Canal, a natural open space area for riparian <br /> habitat and waterway protection shall be maintained to provide nesting and foraging habitat and <br /> the protection of waterway quality. The minimum width of said open space shall be one-hundred <br /> (100) feet, measured from the mean high water level of the natural bank or fifty (50) feet back <br /> from the existing riparian habitat, whichever is greater. Water-dependent uses may be permitted <br /> in this buffer. The open space buffer shall be recorded as a Notice of Minor Subdivision Restriction <br /> with the Certificate of Compliance: <br /> 1. Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this area is <br /> designated as a natural open space for riparian habitat and waterway protection. No <br /> development other than water dependent uses shall be permitted in this space. <br /> e. ACCESS: The following access requirements apply and shall be included in the Certificate of <br /> Compliance property description: <br /> 1. A proposed 25-foot wide private easement for access to Parcels 2 & 3, that extends south <br /> from Howard Road along the eastern boundary of Parcel 1 & 2, shall be included in the <br /> property description for the Certificate of Compliance.
