r:C)NnITIONS r)F APPRQVAI <br /> PA-0400476 <br /> Anaya <br /> Minor Subdivision Application No. PA-0400476 was approved by the San Joaquin County <br /> Community Development Department on October 28, 2004. The effective date of approval is <br /> November 7, 2004. This tentative map approval will expire on November 7, 2007, which is three <br /> years from the effective date of approval, unless (1) all Conditions of Approval have been complied <br /> with and (2) a Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT(Staff Contact: Raymond Hoo, 468-3164) <br /> a. TENTATIVE MAP: The parcel map shall substantially conform with the approved tentative map <br /> dated August 19, 2004. <br /> b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of 330 feet, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> (2) All parcels shall have a minimum lot area of 40 gross acres. (Development Title Section 9-610.2) <br /> c. RIPARIAN HABITAT: Parallel to Paddy Creek, a natural open space for riparian habitat and <br /> waterway protection shall be maintained to provide nesting and foraging habitat and the protection of <br /> waterway quality. The minimum width of said open space shall be one-hundred (100) feet, <br /> measured from the mean high water level of the natural bank or fifty (50) feet back from the existing <br /> riparian habitat, whichever is greater. Water-dependent uses may be permitted in this buffer. <br /> (Development Title Section 9-1510.5) The mean high water level and the edge of the riparian habitat <br /> shall be shown on the Site Plan. The open space buffer required above shall be shown on the <br /> Parcel Map with the following note: <br /> (1) Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this area is <br /> designated as a natural open space for riparian habitat and waterway protection. No <br /> development other than water dependent uses shall be permitted in this space. <br /> d. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-900(b), the following note shall <br /> be placed on the parcel map: <br /> All persons purchasing lots within the boundaries of this approved map should be prepared <br /> to accept the inconveniences or discomforts associated with agricultural operations or <br /> activities, such as noise, odors, insects, dust or fumes. San Joaquin County has determined <br /> that such inconveniencies or discomforts shall not be considered to be a nuisance. <br /> Conditions of Approval - 1 - PA-0400476 <br />
