Order R5-2013-0118 rescinds
Waste Discharge Requirements (WDRs) Order R5-2004-0079, which was adopted by the
Central Valley Water Board on 4 June 2004 to regulate the discharge of wastewater to
land associated with winery operations at Jessie's Grove Winery.
On 18 April 2013, Jessie's Grove Winery and Spenker Ranch Inc. received a Notice of
Applicability under the Conditional Waiver of Waste Discharge Requirements for Small
Food Processors and Small Wineries within the Central Valley Region, Order
No. R5-2009-0097 (Waiver). The Waiver, which was adopted by the Central Valley Water
Board on 8 October 2009, is a conditional waiver of waste discharge requirements for
small wineries and small food processors where discharge to land does not exceed
100,000 gallons per year.
Because current winery activities at the site do not include wastewater discharge to land,
requirements of R5-2004-0079 are no longer relevant. Therefore, Order R5-2004-0079
was rescinded at the 25/26 July 2013 Board meeting. Rescission of the WDRs means that
you are no longer obligated to conduct periodic wastewater and groundwater monitoring
and submit the required monitoring reports under R5-2004-0079. However, because your
facility is now covered under the Waiver, discharge of wastewater to land cannot exceed
100,000 gallons per year unless authorized by other state or local permits. Off-site
wastewater disposal to a permitted facility is allowed.
If you have any questions about rescission of Order R5-2004-0079 or questions about
your permit obligations, please contact Scott Armstrong of the Discharge to Land
Permitting Unit, at (916) 464-4616 or sarmstrongawaterboards.ca.aov.
KARL E.
