CONDITIONS OF APPROVAL <br /> PA-1000097 <br /> Foothill Resource Partners <br /> Lot Line Adjustment Application No. PA-1000097 was approved by the San Joaquin County <br /> Community Development Department on August 31, 2010,which is the effective date of approval. <br /> Unless otherwise specified, all Ordinance requirements shall be complied with prior to approval of a <br /> Notice of Lot Line Adjustment. <br /> This approval will expire on March 1, 2012, which is 18 months from the effective date of approval, <br /> unless a Notice of Lot Line Adjustment has been recorded and a Record of Survey has been filed, if <br /> required by the Land Surveyor's Act. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Contact Staff: John L. Funderburg, 468-3160) <br /> a. APPROVAL: This approval is for a Lot Line Adjustment between two parcels as shown on the <br /> revised site plan dated August 27, 2010. <br /> b. NOTICE OF LOT LINE ADJUSTMENT: A"Notice of Lot Line Adjustment" shall be recorded prior to <br /> conveyance of property through deeds by the owner. Legal descriptions of the resultant properties <br /> shall be submitted to the Surveyor's Division for review and forwarding to the Community <br /> Development Department. The legal descriptions shall be prepared, stamped and signed by a <br /> Registered Civil Engineer, qualified to practice Land Surveying per Section 8731 of the Land <br /> Surveyors'Act, or a Licensed Land Surveyor. (Development Title Section 9-872.4) <br /> c. WILLIAMSON ACT CONTRACT: The property owner shall rescind the current contracts and shall <br /> enter into neyy contracts prior to recording the Notice of Lot Line Adjustment. The Notice of Lot Line <br /> Adjustment shall not be recorded until the Williamson Act Contract has been deemed complete. <br /> Filing fees are required for this application. (Government Code Section 51257) <br /> d. SECOND UNIT DWELLING: (The following requirements shall apply) <br /> (1) A Second Unit Dwelling application shall be filed for the proposed second residence for Parcel <br /> Two before the recordation of the "Notice of Lot Line Adjustment". Upon conveyance of the new <br /> deeds the"Notice of Second Unit Dwelling"will be recorded for proposed Parcel Two. Filing fees <br /> are required for this application. <br /> e. LOT SIZE AND WIDTH: (The following requirements shall apply) <br /> (1) Parcel One shall be a minimum of 150 feet in width, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> (2) Parcel Two shall be a minimum of 330 feet in width, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> 2. DEPARTMENT OF PUBLIC WORKS: (Seethe attached memo dated May 17, 2010) <br /> NOTES AND INFORMATION ONLY: APN: 025-110-09 and 025-110-10 are under Williamson Act <br /> Contract No. 78-C1-Z16. Parcel Two shall not increase in restricted acreage under Williamson Act <br /> Contract No. 78-C1-216 after rescinding and reentering.
