I <br /> Analysis <br /> Minor Subdivision Application No. MS-96-28 and Site Approval Application No. SA-96-69 were submitted <br /> concurrently on October 22, 1996. The Minor Subdivision application is to subdivide a 75.1-acre parcel <br /> into two parcels. Parcel 1 is proposed to be 24.4 acres, and Parcel 2 is proposed to be 50.7 acres. The <br /> Site Approval application is for the purpose of constructing an almond huller station. <br /> jAn almond huller is classified as Agricultural Processing-Preparation Services. The use is permitted in <br /> j the General Agriculture zone subject to an approved Site Approval. Section 9-610.3(d) provides that a <br /> parcel below the zone's minimum area requirement may be created for certain specified uses. Agricultural <br /> processing is one of the specified uses. Section 9-610.3(d)(2), however, further requires that this parcel <br /> be reduced to the least area required to conduct the operation. <br /> The Site Approval application for the proposed almond huller indicates that approximately 1.6 acres are <br />! needed, which is much less than the 24.4 acres proposed. Mr. Moyer was advised prior to filing the <br /> application that creating a 24.4-acre parcel for an almond huller was not consistent with the Development <br /> Title and could not be approved. Mr. Moyer was also advised that he may want to hold up on the Site <br /> Approval application pending the outcome of the Minor Subdivision application. <br /> i <br /> Both applications were scheduled for review with the Development Committee on November 27, 1996. <br /> Neither the owner or his representative appeared for this meeting. One letter was received in opposition <br /> with suggestions on parcel size and locating the huller. On December 9, 1996, staff approved the Minor <br /> Subdivision application subject to Conditions of Approval that are included with the staff report. Condition <br /> No. 1.a.(2) required that Parcel 1 be between 2-5 acres but no larger than necessary to conduct the <br /> almond hulling operation. The 2-5 acres, although larger than the 1.6 acres indicated on the Site <br /> Approval, is much less than the 24.4 acres proposed but does provide for some flexibility in siting and <br /> developing the facility. <br /> On December 12, 1996, Mr. Moyer filed an appeal of staff's approval that is specific to Condition No. <br /> 1.a.(2). The basis for Mr. Moyer's appeal is that the proposed size of Parcel i allows the almond huller <br /> operation to be located at the southwest corner of the parcel, thereby providing an adequate buffer to <br /> accommodate the neighbors. In response, the almond huller's operational area can be established as <br /> a stand-alone parcel in the same location as proposed and accomplish the same thing, as well as being <br /> consistent with the Development Title. <br /> As an alternative to appealing the Conditions of Approval of Minor Subdivision Application No. MS-96-28, <br /> a Deviation application could be processed to permit subdividing the property into two parcels, each of <br /> which would be within 10 percent of the minimum 40-acre parcel size. If the Deviation is approved, a <br /> Revisions of Approved Actions application could be filed to modify Community Development Department <br /> Conditions of Approval No. 1.a. and 1.b. of MS-96-28. <br /> San Joaquin County MS-96-28/Brocchini <br /> Community Development Page 6 <br />
