CONDITIONS OF APPROVAL <br /> MS-94-33 <br /> Erna Murphy <br /> Unless otherwise specified, all Conditions of Approval shall be complied with prior to the approval <br /> of the Parcel Map. <br /> This approval will expire three years from the date of approval unless (1) all Conditions of Approval <br /> have been complied with and (2) a Parcel Map has been filed with and accepted by the Surveyor's <br /> Office. <br /> Those Conditions followed by a Section Number or other Statutory Requirement are based on <br /> Ordinance requirements. Ordinance requirements cannot be modified. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: <br /> a. Parcel 1 shall be between two net acres and five gross acres in size. (Development Title <br /> Section 9-610.3[a]) <br /> b. Parcel 1 shall have a minimum width of 150 feet. (Development Title Section 9-610.4) <br /> C. A Note shall be placed on the Parcel Map, a Notice of Minor Subdivision Restriction shall <br /> be recorded concurrently with the Parcel Map to the effect that the homesite is restricted <br /> from transfer until September 17, 2004, and the property shown on the Parcel Map is <br /> restricted from further subdivision, for homesite purposes, by Section 9-610.3 of the San <br /> Joaquin County Ordinance. <br /> d. Parallel to the north fork of Little John's Creek, a natural open space for riparian habitat <br /> and waterway protection shall be maintained to provide for nesting and foraging habitat <br /> and the protection of waterway quality. The minimum width of said open space shall be <br /> 100 feet, measured from the mean high water level of the natural bank, or 50 feet back <br /> from the existing riparian habitat, whichever is greater. Water-dependent uses may be <br /> permitted in this buffer. The mean high water level and the edge of the riparian habitat <br /> shall be shown on the Parcel Map. The open space buffer required above shall be <br /> shown on the Parcel Map with the following note: <br /> Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this <br /> area is designated as a natural open space for riparian habitat and waterway <br /> protection. No development other than water dependent uses shall be permitted <br /> in this space. <br /> e. All development shall comply with the "Trees" Chapter of the Development Title. <br /> (Development Title Section 9-1505) <br /> f. If, in the course of development, concentrations of prehistoric or historic-period materials <br /> are encountered, all work in the vicinity of the find shall halt until an archaeologist can <br /> evaluate the materials and make recommendations for further action. If human remains <br /> are encountered, all work shall halt in the vicinity and the County Coroner shall be notified <br /> immediately.
