CONDITIONS OF APPROVAL <br /> FARMINNTON EQUITY PTP/DILLON & MURPHY <br /> PA-1200049 <br /> Minor Subdivision Application No. PA-1200049 was approved by the San Joaquin County <br /> Community Development Department on July 2, 2012. The effective date of approval is July 12, <br /> 2012. This tentative map approval will expire on July 12, 2015, which is three years from the <br /> effective date of approval, unless (1) all Conditions of Approval have been complied with and (2) a <br /> Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Rick Griffin, [209]468-3154) <br /> a. TENTATIVE MAP: The parcel map shall substantially conform with the approved tentative <br /> map dated March 27, 2012. <br /> b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this <br /> map: <br /> (1) Parcel 1 shall have a minimum lot width of 150 feet. (Development Title Section 9- <br /> 610.4) <br /> (2) Parcel 1 shall be between two (2) net acres and five (5) gross acres in size. <br /> (Development Title Section 9-610.3[a]) <br /> c. RIGHT TO FARM: A Note shall be placed on the Parcel Map and a Notice of Minor <br /> Subdivision Restriction shall be recorded concurrently with the Parcel Map, with a reference <br /> to the instrument number of said recorded notice, stating that: <br /> (1) All persons purchasing lots within the boundaries of this approved map should be <br /> prepared to accept the inconveniences or discomforts associated with agricultural <br /> operations or activities, such as noise, odors, insects, dust or fumes. San Joaquin <br /> County has determined that such inconveniences or discomforts shall not be <br /> considered to be a nuisance. (Section 6-9004[b]) <br /> d. TRANSFER RESTRICTION: A Note shall be placed on the Parcel Map and a Notice of <br /> Minor Subdivision Restriction shall be recorded concurrently with the Parcel Map, with a <br /> reference to the instrument number of said recorded notice, stating that: <br /> (1) The homesite shall not be transferred until (10 years from the date of <br /> approval), or upon the death of an owner owning at least fifty (50) percent <br /> interest in the homesite parcel, unless the homesite parcel and the remainder <br /> parcel are merged pursuant to the provisions of the Development Title. <br />
