CONDITIONS OF APPROVAL <br /> PA-0700450 <br /> Bianchi <br /> Agricultural Excavation Application No. PA-0700450 was approved by the San Joaquin County <br /> Community Development Department on December 19, 2007. The effective date of approval is <br /> December 29, 2007. This approval will expire on June 29, 2009, which is 18 months from the <br /> effective date of approval, unless (1) all Conditions of Approval have been complied with and (2) all <br /> necessary permits from other agencies have been secured and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified,and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Contact Staff: Corinne King, [209] 953-7509) <br /> a. IMPROVEMENT PLAN: Submit an "APPLICATION-SITE IMPROVEMENT PLAN". A fee is <br /> required for the Site Plan review. <br /> b. APPROVED USE: This approval is for the excavation and removal of 98,876 cubic yards of soil and <br /> the reclamation of the land to an agricultural use in two phases. Phase one to be completed in 18 <br /> months. Phase two to be completed in 36 months from the date of approval. <br /> c. STORM DRAINAGE: Stormwater drainage shall be retained on-site. The drainage pattern and <br /> corresponding storm drain improvements shall be shown on the Site Plan. Drainage calculations <br /> prepared by a registered civil engineer or architect shall be included. (Development Title Section 9- <br /> 1135) <br /> d. PRIVATE ROADS: All private roads involved in an excavation shall be maintained so as to control <br /> the creation of dust. The first one hundred (100) feet of any private road on the property which <br /> intersects with a publicly maintained road shall be surfaced in a manner approved by the Director. <br /> Traffic-control and warning signs shall be installed, if required, at such intersection. The placement <br /> and size of these signs shall be approved by the Director of Public Works. (Development Title <br /> Section 9-1410.3[a]) <br /> e. FINAL GRADE: The final grade shall: <br /> (1) Not result in disruption of the flow of drainage water from the property of adjoining properties; <br /> (2) Not adversely affect the irrigability of the property or surrounding properties. If the property is <br /> within an irrigation district, the final grade shall be limited to that elevation which is necessary to <br /> provide gravity irrigation to the property. This determination may be made by the irrigation <br /> district; <br /> (3) Not adversely affect the relation of the water table to the surface of the land; <br /> (4) Have an average elevation no less than the average elevation of the natural grade of the <br /> surrounding land. The average elevation of the natural or existing grade shall be the average <br /> elevation of all land 100 feet from the perimeter of the proposed excavation, excluding any <br /> portion of the perimeter adjacent to a river, river-bank, levee, public road, railroad, canal, <br /> pipeline, or other similar uses or rights-of-way. <br /> Conditions of Approval - 1 - PA-0700450 <br />
