The facility was inspected <br /> to determine compliance with Waste Discharge Requirements (WDRs) Order No. <br /> 135-2002-0148. <br /> As described in the enclosed inspection reports for the 23 March and 18 May 2006 <br /> inspections, Regional Water Board staff observed that, in general, the application of <br /> wastewater containing elevated concentrations of salt constituents, especially sodium, has <br /> adversely impacted land application area soils to the extent that they support little, if any, crop <br /> growth. Erosion damage from wastewater and stormwater runoff is severe in places, and has <br /> caused excessive sediment accumulation in portions of the land application area. <br /> Of special concern is Regional Water Board staff's 18 May 2006 inspection documentation that <br /> indicates Olive-processing wastewater spilled from various land application areas to surface <br /> water drainage courses, including an unknown quantity likely discharged to the California <br /> Aqueduct. Discharges of process wastewater to surface water drainage courses are not <br /> permitted by the general industrial stormwater permit (Water Quality Order No. 97-03-DWQ). <br /> California Water Code Section 13376 requires any person discharging pollutants to navigable <br /> waters of the United States within California to file a report of waste discharge. Discharges to <br /> surface waters are regulated by federal and state law and require a separate permit. Please <br /> be aware that discharges to surface waters make Musco vulnerable to citizen lawsuits <br /> authorized by the Clean Water Act. <br /> The following violations of WDRs Order No. R5-2002-.0148 were observed during the 23 March <br /> and 18 May 2006 inspections: <br /> Discharge Prohibition A.1 (both inspections), which prohibits "[t]he direct or indirect <br /> discharge of wastes to surface waters.or surface water drainage courses". <br /> California Environmental Protection Agency <br /> py°a Recycled Paper <br />
