Planning Commission <br /> Use Permit U-78-9 <br /> January18, 1994 <br /> Page 2 <br /> In October 1993,the department again was notified of apparent violations on the site through Supervisor <br /> George Barber. Field investigation again found that boats and recreational vehicles were being lived in. <br /> Several boats stored on the property were being worked on by their owners, performing everything from <br /> minor repairs to the complete major overhaul of a boat that was extensively damaged by fire. The mobile <br /> office was still being used without permits. The property owner was notified concerning these continuing <br /> violations. <br /> In December, a follow-up investigation revealed three recreational vehicles and two boats still hooked up <br /> to electric and water, and apparently being used as living quarters; and some boats, trailers and <br /> equipment are being stored on an adjacent property; and the mobile office is still present and absent any <br /> permits. The Improvement Plan has not been completed, and a Business License has not been <br /> requested. The property is currently owned by Jean M. Hunt and is leased to Lee Coulter who operates <br /> the business. <br /> The process for initiating a revocation or modification of an approved Use Permit is specified in Chapter <br /> 9-230, 'Revocation Procedure.' Initiation of this process can only be by the Planning Commission or the <br /> Board of Supervisors. The basis for revoking or modifying an approved Use Permit is a finding by the <br /> Commission of one or more of the following: <br /> 1. Fraud: That such development approval was obtained or extended by fraud; <br /> 2. Violation of Condition: That one or more of the conditions upon which such development <br /> approval was granted have been violated; or <br /> 3. Adverse Impacts: That the use or facility for which the development approval was <br /> granted is so conducted or maintained as to be detrimental to the public health or safety, <br /> or as to be a public nuisance. <br /> The Commission is being asked to decide whether or not to hold a public hearing to consider the <br /> revocation or modification of Use Permit U-78-9 based on information presented. If the Commission <br /> decides to hold a public hearing, a date will be set by staff and appropriate notification will be given.
