Analysis <br /> Background <br /> On April 28, 2006, the Community Development Department approved Site Approval Application No. <br /> PA-0600033 for a small winery with a tasting room with a maximum of four marketing events per year with <br /> a maximum attendance of forty people per marketing event. (Use Type:Wineries and Wine Cellars- <br /> Winery, Small) Improvements were constructed and the winery was established. <br /> Marketing Events <br /> If the project is approved, there will be sixteen marketing events per year. The applicant anticipates a <br /> maximum attendance of 120 people per marketing event and the marketing events will operate from <br /> 12:00 p.m. to 9:30 p.m. <br /> Lot Line Adiustment <br /> On November 1, 2010, the Community Development Department approved Lot Line Adjustment <br /> Application No. PA-1000219, which adjusted the property lines to the configuration depicted on the site <br /> plan. The Notice of Lot Line Adjustment was recorded but title was not transferred reflecting the adjusted <br /> lot line configuration. As a Condition of Approval, new recorded deeds shall be submitted reflecting the <br /> lot line adjustment prior to approval of the Improvement Plan. <br /> Noise <br /> There are scattered residences along the perimeter of the subject parcels. The nearest residence is <br /> located on the adjacent parcel to the north, 300 feet north of the winery operations. Pursuant to <br /> Development Title Section 9-1025.9(a)(1), a residential use is a noise sensitive land use. In addition, <br /> noise sources emanating from any agricultural operations, including activities associated with the process <br /> or transportation of crops when such activities are conducted on agriculturally zoned lands are exempt <br /> from the Noise ordinance. However, marketing events must comply with Development Title Section 9- <br /> 1025.9 regarding stationary noise standards (50 dB Hourly Equivalent Sound Level daytime, 45 dB <br /> Hourly Equivalent Sound Level nighttime, 70 dB maximum sound daytime, 65 dB maximum sound <br /> nighttime). Marketing events must end by 10:00 p.m. The applicant has indicated there will not be <br /> amplified sound either indoors or outdoors at the marketing events. If the applicant decides to propose <br /> amplified sound for marketing events in the future, then the applicant would need to apply for a Revision <br /> of Approved Actions Application and a noise study will be required to ascertain noise impacts to noise <br /> sensitive land uses. <br /> Williamson Act <br /> This parcel is subject to Farmland Security Contract No. FA-99-0073. The contract restricts development to <br /> uses that are compatible with the Williamson Act and Development Title Section 9-1805. "Compatible use" <br /> as defined in the Williamson Act includes uses determined by the County to be compatible with the <br /> agricultural, recreational, or open-space use of land within the preserve and subject to contract. <br /> (Government Code Section 51201[e]) A winery is a compatible use with property under contract pursuant to <br /> Development Title Section 9-1810.3(b)(1)(AA). The parcel has approximately 10 acres of vineyards and <br /> the winery and marketing events will encompass approximately 2.5 acres. The applicant produces 4,800 <br /> gallons of wine per year and will have wine available for sale at each marketing event. The wine will be sold <br /> exclusively from the host winery. The winery will encourage an existing agricultural use and therefore, the <br /> use is consistent with the required three Principles of Compatibility pursuant to Government Code Section <br /> San Joaquin County PA-0600033\Hoffman <br /> Community Development Page 3 <br />
