Analysis <br /> On December 6, 2000, the Community Development Department approved Site Approval No. SA-00-65 for <br /> a double-faced, off-premises, outdoor advertising sign. On December 14, 2000, David Atwater filed an <br /> appeal of the Community Development Department's approval of the Site Approval. <br /> Mr. Atwater's Appeal <br /> Appeal Statement No. 1 <br /> Major changes of the Interstate 5/French Camp off ramp are planned in the future. The installation of the <br /> sign could be in conflictwith the options being considered by Cal Trans and by the City of Stockton as part of <br /> the"French Camp—Arch Road Expressway." <br /> Response to Appeal Statement No. 1 <br /> On November 2, 2000, a project referral was sent to the Department of Transportation(Cal Trans) and the <br /> City of Stockton. Cal Trans did not respond to the application referral. The City of Stockton Public Works <br /> Department did respond on November 27, 2000. The response noted that the project does lie within <br /> proposed Interstate 5/French Camp improvement area and that the sign should not be located in the public <br /> right-of-way or any public utility easements. Pacific Gas & Electric was also notified of the project and did <br /> respond,stating that there is an existing overhead electric pole line within the subject parcel and that the sign <br /> should be located at least 10-feet from the nearest conductor of said pole line. Upon review of the project, <br /> the Community Development Department has concluded that the project site does not lie within the public <br /> right-of-way or within any public utility easements. <br /> Appeal Statement No.2 <br /> The sign blocks visibility of Mr.Atwater'sfacility and signs. <br /> Response to Appeal Statement No. 2 <br /> On December 29, 2000, a site inspection was performed at the project site, as were numerous drive-by <br /> inspections of the site along Interstate 5 (travelling north and south). At the completion of these <br /> inspections, the Community Development Department concluded that the applicant's sign would not <br /> visually conceal the appellant's facility and/or signs. <br /> Appeal Statement No. 3 <br /> Billboards are an eyesore and should not be permitted. <br /> Response to Appeal Statement No. 3 <br /> Off-premises advertising signs are consistent with the General Plan and are a conditionally permitted use in <br /> the C-FS zone with an approved Site Approval. Also, the Initial Study prepared for the project did not reveal <br /> any significant aesthetic impacts that the project would have on the surrounding area, and the project is <br /> compatiblewith surrounding commercial uses. <br /> San Joaquin County SA-00-65\JJS &G <br /> Community Development Page 3 <br />
