Alcon Tire Shop <br /> Page 3 of 4 <br /> having jurisdiction over a particular facility determines that a different requirement is <br /> necessary or adequate to meet the intent of this regulation for the prevention of fire <br /> and the protection of life and property. If such determination is made, written <br /> notification from that fire authority shall be provided to the CIWMB. <br /> (C) Surface water drainage shall be directed around and away from the waste tire storage <br /> area. <br /> (D) Waste tires at an existing waste tire facility shall not be stored on surfaces with grades <br /> that will interfere with fire fighting equipment or personnel unless mitigation measures <br /> have been approved in writing by the local fire authority, or a fire safety engineer <br /> registered by the State of California. Measures established by a fire safety engineer <br /> shall be subject to approval by the local fire authority. <br /> (E) Tires must be removed from rims immediately upon arrival at the facility. <br /> (F) The site shall be designed and constructed to provide protection to bodies of water <br /> from runoff of pyrolytic oil resulting from a potential tire fire. <br /> Please inform CIWMB staff on the future disposition of these waste tires. Pursuant to 14 <br /> CCR § 18420(a), all operators of major or minor waste tire facilities that store, stockpile, <br /> accumulate, or discard waste tires shall acquire a Permit. If a Permit is not obtained, an <br /> acceptable plan for the reduction in the amount of waste tires, including time frames, shall be <br /> required. <br /> CIWMB staff is available to assist you with specific questions or concerns regarding these <br /> requirements. You may also consider obtaining the services of a consultant to assist you in <br /> this matter. Please be advised that if this plan is not received by November 15, 1997, a <br /> Clean-up & Abatement Order setting deadlines and penalties may be issued. <br /> Should you have any questions regarding this letter, please do not hesitate to contact me at <br /> (916) 255-3847. <br /> Sincerely, <br /> Keith E.
