Tom Daniels enforcement action summary: <br /> 4/10/2008: Attempted to perform a waste tire inspection that was scheduled for 10:OOAM at 2210 <br /> Country Club Blvd. Tom Daniels never showed up. Called Mr. Daniels and he said that he forgot <br /> about the inspection. He rescheduled the inspection for Friday 4/11/2008 at 10:OOAM. Jenni <br /> Frase and Robert McClellon were present. <br /> 4/11/2008: Attempted to perform the waste tire inspection that Mr. Daniels rescheduled. Mr. <br /> Daniels never showed up for the inspection. <br /> 4/29/2008: Conducted a waste tire inspection on Tom Daniels Properties located at 2210 <br /> Country Club Blvd., Stockton CA (TPID# 1423339). It was noted that Mr. Daniels had <br /> approximately 600 tires stored in a semi truck trailer on the property. Mr. Daniels was issued a <br /> violation of PRC #42834 (unpermitted minor waste tire facility) on the CIWMB Waste Tire Survey <br /> & Inspection Report (Inspection Report Number 11-1088220) and given 30 day to remove the <br /> waste tires or file for a permit. <br /> 6/25/2008: A joint inspection with staff of the CUPA unit of the Environmental Health Department <br /> was conducted and it was noted that the tires were still present in the trailer. <br /> 6/26/2008: Had a meeting with Mr. Daniels to discuss the waste tires. He informed me that he <br /> did not have anybody to remove the tires. He informed me that he would self haul the tires in <br /> quantities of 9 or fewer at a time to the landfill or transfer station. I was told to inform him that if <br /> he chose to self haul the tires that a representative from the Environmental Health Department <br /> would need to be present and that our hourly rate of$98.00 would apply. I provided the list of <br /> registered waste tire haulers for San Joaquin County and he informed me that he would contact <br /> one of them to have the tires removed. I told him to contact me when he had a pick up date and <br /> time so that I could witness the removal of the tires. <br /> 7/11/2008: Performed a site visit to check on the status of the waste tires. It was noted that 2 or <br /> 3 trailers had been removed from the property. It was also noted that the tires had been removed <br /> from the trailer and were now piled on the ground. <br /> 8/4/2008: After contacting Mr. Daniels he claimed that the tires were not his tires and that the <br /> person that the tires belonged to had passed away. The EHD sent Mr. Daniels a notice to <br /> abate regarding the tires (see attached). Mr. Daniels was given three weeks to remove the tires. <br /> 8/22/2008: A re-inspection was conducted to determine compliance with the notice to abate. The <br /> tires were still present. The re-inspection again noted a violation of PRC #42834 (unpermitted <br /> minor waste tire facility) and referral to CIWMB for enforcement. At this time, Mr. Daniels is <br /> taking the position that the tires are not his tires and he is not responsible for them. <br />
