I final judgment has expired and should have no further force and effect. Defendant shall meet and <br /> 2 confer with the People prior to filing such notice in an attempt to agree to a Stipulated Notice of <br /> 3 Termination that may be filed by the parties and would terminate the injunctive provisions of this <br /> 4 final judgment. After the filing of the Stipulated Notice of Termination, signed by all parties, the <br /> 5 injunctive provisions would have no further force or effect after the filing of said notice. Should the <br /> 6 parties fail to come to an agreement regarding the termination and Defendant files a Notice of <br /> 7 Termination, the injunctive provisions of this final judgment will be of no further force or effect <br /> 8 sixty(60) days thereafter,unless the People file a motion contesting the expiration of any injunctive <br /> 9 provisions within forty (40) days of receipt of the Notice of Termination. In the event that such <br /> 10 motion is filed, none of the injunctive provisions of the final judgment contested in the People's <br /> 11 motion will terminate pending the Court's ruling on the motion. The People reserve the right to <br /> 12 contest termination on the grounds that Defendant has not substantially complied with the injunctive <br /> 13 provisions of the Permanent Injunction and Final Judgment Pursuant to Stipulation and to offer any <br /> 14 evidence relevant to such motion. Defendant reserves its rights to respond to any ground raised in <br /> 15 the People's motion and to offer any evidence relevant to such motion. The injunctive provisions in <br /> 16 this final judgment will expire and be of no further force or effect unless the Court (upon <br /> 17 consideration of the Parties' pleadings and arguments, if any) determines that the expiration of the <br /> 18 provision at issue would not be in the interest of justice, because Defendant has not substantially <br /> 19 complied in material respects with this Permanent Injunction and Final Judgment Pursuant to <br /> 20 Stipulation.
