I preferred to discuss this with you over the phone but was told by Carol Oz last.Friday i that I had to do so in writing. I am very aware of Proposition;65 and was surprised to hear that Stockton Plant #33 was put on a Proposition 65 list ofcontaminated sites. I had never heard of a "Prop 65 list" even though I?work with production facilities in seven California counties. 'I also did not realize there was contamination at Plant #33, nor was I aware of any conditions which might be construed as contamination under California,Health and Safety Code Section 25180.7(b),. which requires a federal employee to report if an illegal discharge, or threatened illegal discharge, of hazardous wastes is revealed, and who knows the discharge, or a threatened discharge, is likely to cause substantial injury to the public health';or safety (not the case as far as we know) . My surprise stems from what` I know happened when the tanks were removed in the fall of 1985. we wanted to take all the proper steps required in removing the tanks so 'Exceltech was contracted to handle this project.
