However, your proposed due date (31 <br /> December 1987) is unacceptable. <br /> We recognize that O/LDC has submitted a closure plan to the <br /> Department of Health Services and the Board and is presently <br /> awaiting approval. We also recognize that O/LDC intends to close <br /> their surface impoundment (SI) prior to 31 December 1987. <br /> However, as you correctly pointed out in your 23 March letter to <br /> us, it is necessary for Board staff to review the HAR in order to <br /> confirm that the proposed closure activities are appropriate for <br /> your SI. Therefore, it is necessary that O/LDC include in the <br /> closure plan the pertinent HAR information that adequately <br /> documents their proposed closure activities. since it is likely <br /> that any additional information will have to be obtained prior to <br /> or during the closure of the SI, we intend to review the <br /> information contained in your closure plan to determine if it <br /> adequately supports your proposed method of closure and also to <br /> determine if additional or supplemental information is needed to <br /> address the HAR requirements contained in Section 25208. 8 of <br /> TPCA. <br /> In addition, our staff is faced with numerous HAR reviews that <br /> must be completed by the end of this year. It is necessary to <br /> distribute our workload over the remaining calendar year to <br /> assure that all the HARs will be adequately reviewed and also to <br /> allow for any necessary amendments prior to the 31 December 1987 <br /> (deadline for the submission of a "completed HAR") . Based on <br /> these considerations we have determined that a more appropriate <br /> date for the submission of your HAR should be 1 October 1987 . <br /> Finally, You intend to perform further testing of the sludges <br /> contained in the SI. If the results of this testing indicates <br /> that the materials contained in the SI are below hazardous levels <br /> and O/LDC can document that their SI did not contain hazardous <br />
