SAN J O A Q U I N Environmental Health Department <br /> COUNTY <br /> WASTE DISCHARGE/SPILL RESPONSE <br /> NOTICE TO ABATE <br /> Responsible Party: LEHIGH HANSON Date: Jun 05, 2019 <br /> RP Mailing Address: 7675 N INGRAM AVE SUITE 104 Record ID#: COLNAGDWO <br /> Fresno, CA 93711- Program Element: 2546 <br /> Spill Location: BIRD RD,TRACY Release/Spill Response(excluding Joint Team) <br /> NATURE OF WASTE DISCHARGEIWASTE RELEASE: <br /> A cement truck accident caused the release of 30 gallons of diesel fuel and oil. <br /> OBSERVATIONS: <br /> Arrived on site and met with CHP Sargent Danny Lecce, Public Works employee Bryan Closs, and the responsible party <br /> representative, Christopher Hughes, Senior Transportation Supervisor,with Lehigh Hanson. Oil and diesel puddles were <br /> observed at the area of the crash. A saddle tank(belonging to the cement truck)was on the ground. According to the <br /> driver,the tank had 45-48 gallons of fuel. The south county fire department and All Star Inc.towing company contained the <br /> spill to the roadway and a dirt road divider using absorbent. The spill is currently being cleaned up by All Star Inc. and the <br /> San Joaquin County Public Works Department. <br /> VIOLATIONS: <br /> Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> ° Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> Other Violation <br /> ORRECTIVE ACTIONS/ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> Immediately. <br /> • Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> Submit final disposal records to the EHD when they are received. <br /> ° Other Correction <br /> COST RECOVERY: All EHD time associated with this Spill Response is billed to the responsible party at the current hourly <br /> rate.
