PA1800030 <br /> Before the Board of Supervisors <br /> County of San Joaquin, State of California <br /> R-07-520 <br /> RESOLUTION APPROVING SPECIAL PURPOSE PLAN NO. PA-0600644 <br /> OF CGKL KAMILOS DEVELOPMENT INC. FOR THE MOUNTAIN HOUSE <br /> NEW COMMUNITY. <br /> WHEREAS, on August 2,2007,the San Joaquin County Planning <br /> Commission considered this matter;and <br /> WHEREAS,on September 11,2007,this Board of Supervisors did conduct a <br /> public hearing on said matter,notice of said hearing having been given in accordance <br /> withlaw,andoral and documentary evidence having been received infavorofor <br /> opposed to said matter,and this• Board of Supervisors being advised on the premises; <br /> and <br /> WHEREAS,this Board of Supervisors found that an Environmental Checklist <br /> ("Checklist') was prepared for the project and the Checklist concluded that: 1) The <br /> Specific Plan III Environmental Impact Report (SPREIR) has been prepared and <br /> certified; 2) all potentially significant impacts of Specific Plan III have been addressed <br /> in the SPII IEI R;3)the proposed project is a subsequent activity that is within the scope <br /> of the SPIIIEIR;4)the environmental review("Checklist")for the project found that there <br /> are no effects thatwere not examined in the SPIIIEIR and no new mitigation Is <br /> required; and 5) therefore, as provided by California Environmental Quality Act <br /> ("CEQA") Guidelines Section 15168 (c), no new environmental document is required; <br /> and <br /> WHEREAS,this Board of Supervisors determined that said Special Purpose <br /> Plan is consistent with the General Plan and the Public Financing Plan and does not <br /> adversely affect the Job/Housing Program and housing affordability and meets all <br /> applicable provisions ofth PCCP Mountain House, LLC Development Agreement based <br /> on the Bases for Master Plan Amendment contained in the Cassano/Kamilos Homes <br /> Project staff report; <br /> NOW, THEREFORE, BE IT RESOLVED by this Board of Supervisors that: <br /> 1. The Cassano Kamilos Homes at College Park Special Purpose Plan for the <br /> Mountain House New Community Is hereby approved by approval of the <br /> following: <br /> SPECIAL PURPOSE PLAN PA-0600644,with the Bases forSpecial Purpose <br /> Plan and with said Cassano Kamilos Homes at College Park Special Purpose Plan <br /> attached hereto as Exhibit"A"and as Exhibit"8"respectively,and made a part of <br /> this Resolution. <br />
