Box 8595 <br /> Stockton, CA 95208 <br /> Dear Mr. Merk: <br /> BEAVER CHEMICAL COMPANY, SAN JOAQUIN COUNTY, EXEMPTION <br /> DETERMINATION <br /> The Department has determined that Beaver Chemical Company' s <br /> industrial waste pond does not require a hazardous waste <br /> facility permit. Our staff and the Regional Water Quality <br /> Control Board inspected your facility on March 14, 1985 and <br /> August 26, 1985, respectfully. Samples of your industrial <br /> waste pond were collected at both inspections and analyzed. <br /> The analysis provided by California Analytical Labs, Inc. <br /> and Department of Health Services, Hazardous Materials <br /> Laboratory, indicated that neither the sludge nor the <br /> liquids contained in the industrial waste pond is hazardous, <br /> as defined in Article 11, Title 22, California <br /> Administrative Code. <br /> This hazardous waste facility permit exemption applies only <br /> if the wastes streams entering the industrial waste ponds <br /> remain nonhazardous. If these wastes streams become <br /> hazardous in the future, the industrial waste pond would be <br /> subject to State and Federal regulations, and you would be <br /> required to apply for a hazardous waste facility permit. <br /> If you have any questions regarding the content of this <br /> letter, please contact John Papathakis at (916) 739-3142 . <br /> Sincerely, <br /> James T.
