At that time, I explained to Mr. Ellis the problems associated with breaking an <br />agreement with this office; <br />21) That upon my return to the office, on Monday, May 8th, I reviewed Mr. Ellis' letter, <br />which requested the date of May 17, 2000 to file the answer; (See Attachment A to this Declaration) <br />22) That after conversing with Mr. Ellis and then upon reviewing Mr. Schuckman's daily <br />messages from May 3, 4 and 5, including the tenor, and his letter dated May 8, (See Exhibit C, to <br />defendants moving papers) I decided to send a quick note clarifying the process necessary in this <br />case to Mr. Schuckman via facsimile; <br />23) That I was out of the office from noon on May 8, 2000 through May 9, 2000 at 10 <br />I P.m.; <br />24) That I sent the facsimile to Mr. Schuckman early in the morning of May 10, 2000. <br />That in that fax I gave Mr. Schuckman the time to file answer that was requested by Mr. Ellis in his <br />April 27, 2000 letter; <br />25) That I sent a letter to Mr. Ellis early in the morning of May 10, 2000 indicating my <br />concerns and agreeing to his May 17, 2000 request; (See Attachment B to this Declaration) <br />26) That after I received Mr. Schuckman's letter dated May 16, 2000, I again reviewed <br />the applicable law and offered to make minor changes to the complaints in exchange for a stipulation <br />regarding taking the demurrer off calendar and filing an answer by a given date; (See Attachment C <br />to this declaration) <br />/// <br />/// <br />
