Tom Wise - 2 - 4 February 2005 <br /> Designated waste means either of the following: (a) Hazardous waste that has been granted <br /> a variance from hazardous waste management requirements pursuant to Section 25143 of the <br /> Health and Safety Code. <br /> (b) Nonhazardous waste that consists of, or contains, pollutants that, under ambient <br /> environmental conditions at a waste management unit, could be released in concentrations <br /> exceeding applicable water quality objectives or that could reasonably be expected to affect <br /> beneficial uses of the waters of the state as contained in the appropriate state water quality <br /> control plan. <br /> Disposal Method <br /> Wastewater is discharged to a storm water pond on the east side of the facility. Discharge of the <br /> wastewater is not appropriate because the wastewater is not contained in a Class II impoundment, or <br /> adequately treated as required by Title 27 Section 20250. The discharge owastewater is likely to <br /> degrade groundwater quality by increasing the TDS concentration in groundwater. <br /> Conclusions <br /> Based on evaluation of the available data, wastewater generated at the facility is classified as designated <br /> waste as defined by California Water Code 13173(b). California Water Code Section 20090 does riot <br /> exempt the wastewater from the requirements of Title 27. Because the wastewater is designated waste, <br /> the discharge cannot be issued Waste Discharge Requirements that allow land application and are a <br /> violation of WDRs Order No. 96-117 Discharge Prohibition A.3, which states: <br /> Discharge of waste classified as "hazardous"or "designated, " as defined in Sections 2521(a) and <br /> 2522(a) of Chapter 15, is prohibited. <br /> Furthermore, WDRs Groundwater Limitations D.1,D.2, D.S, and D.6 are all applicable to the discharge <br /> because the result of the discharge is likely to impact groundwater quality. The WDRs' Groundwater <br /> Limitations state the following: <br /> The Discharge shall not cause underlying groundwater to: <br /> 1. Be degraded. <br /> 2. Contain chemicals, heavy metals, or trace elements in concentrations that adversely affect <br /> beneficial uses or exceed maximum contaminant levels specified in 22 CCR, Division 4, <br /> Chapter 15. I <br /> 5. Contain taste or odor producing substances in concentrations that cause nuisance or adversely <br /> affect beneficial uses. <br /> 6. Contain concentrations of chemical constituents in amounts that adversely affect agricultural <br /> use. <br /> The Title 27 program could possibly regulate the wastewater generated at the facility, but significant <br /> improvements to storage areas and/or treatment of the wastewater prior to discharge would be required <br /> to comply with Title 27 requirements. <br /> W 151a1➢ObncnRanhaquin�arye AW=3 Feb 05 doc <br />
