PA-1800043 (SA) Findings <br /> 1. The proposed use is consistent with the General Plan, any applicable Master Plan, Specific Plan, and <br /> Special Purpose Plan and any other applicable plan adopted by the County. <br /> • This finding can be made because the Gasoline Sales and Service-Combination use type is <br /> consistent with the General Plan's Limited Industrial (I/L) designation and in turn may be <br /> conditionally permitted with a Site Approval application in the Limited Industrial (I-L) zone. <br /> The proposed gasoline station is consistent with the goals, policies, standards, and maps of <br /> the General Plan, and there are no Master Plans or Special Purpose Plan applicable to this <br /> site. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because the necessary facilities and improvements are existing or <br /> proposed. The applicant has supplied will-serve letters from the City of Stockton for public <br /> sanitary sewer service, and the California Water Company for public water supply. Also as a <br /> Condition of Approval, the Department of Public Works is requiring the developer to provide <br /> drainage facilities that meet the requirements of San Joaquin County Development Standards <br /> for any additional runoff attributed to this project development. As a Condition of Approval, <br /> the applicant must comply with the Underground Storage Tank Program through the <br /> Environmental Health Department for the proposed underground storage tanks. Additionally, <br /> as a Condition of Approval, the Community Development Department will require a minimum <br /> ten (10) foot landscaped strip respecting the ultimate Right-of-Ways of South State Route 99 <br /> West Frontage Road and South Mariposa Road. As a result, the project will improve the <br /> aesthetics of the general vicinity. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the 2.00-acre parcel is of adequate size and shape to <br /> accommodate the proposed fuel station and convenience store and all necessary <br /> improvements.The site plan shows that there is sufficient area for parking and circulation, in <br /> compliance with Standards of the Development Title.The access driveways meets the twenty- <br /> five (25)foot minimum requirement for two-way access. In addition, the Department of Public <br /> Works is requiring the northwest driveway with access on South State Route 99 West <br /> Frontage Road be limited to right in/right out movements, include a channelizing raised <br /> median island to facilitate right in/right out movements,and include signage indicating "right <br /> turn only" viewable to traffic exiting the site. An additional sign facing the public roadway <br /> shall indicate "no left turns" into the site will be required. These measures will ensure the <br /> project will have less than significant impacts on traffic levels of service. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare or be <br /> injurious to the property or improvements of adjacent properties <br /> • This finding can be made because the Initial Study prepared for the project found no potentially <br /> significant environmental impacts. In addition, a Traffic Impact Analysis was completed by <br /> Kimley-Horn on November 12, 2018 which found there were no traffic impacts as a result of the <br /> project. The Department of Public Works is has incorporated the recommendations from the <br /> Traffic Impact Analysis in their recommended Conditions of Approval. <br /> PA-1800043 (SA) Findings 1 <br />
