Because of the special circumstances applicable to the property including size,shape,topography, <br /> location, or surroundings,the strict application of the regulations deprives the property of privileges <br /> enjoyed by other property in the vicinity and under identical zoning classification; <br /> • The request of this variance is for the County of San Joaquin to permit a reduction to the side <br /> street setback distance from the County's regulation of 20'and permit the project to adhere to <br /> the City of Stockton side street setback regulation of 10'. <br /> • The project site is located within the City of Stockton limits and properties in the surrounding <br /> vicinity and zone are held to the City of Stockton regulation of a side street setback of 10'. <br /> • The application of the County of Stockton's side street setback distance regulation does not <br /> align with the setback distance regulation of neighboring properties in the vicinity, in which the <br /> City of Stockton side street setback distance is followed. <br /> 2. The granting of the Variance will not constitute a grant of special privileges inconsistent with the <br /> limitations upon other properties in the vicinity and zone in which the property is situated. <br /> • The granting of this variance does not constitute special privileges. Properties in the <br /> surrounding vicinity and zoning areas are within the City of Stockton limits, and are therefore <br /> held to the City of Stockton setback regulation of 10'for side streets as identified within table <br /> Table 2-3, Stockton Municipal Code, Section 16.24.200. <br /> • The San Joaquin County PHS variance request aligns with the City of Stockton regulations for <br /> side street setback distance of 10'. The request of this variance only applies to the side street <br /> setback reduction to 10'. <br /> 3.
