The District has determined that the mitigated <br /> baseline emissions for construction and operation will be less than two tons NOx per year <br /> and two tons PM10 per year. Pursuant to District Rule 9510 Section 4.3, this project is <br /> exempt from the requirements of Section 6.0 (General Mitigation Requirements) and <br /> Section 7.0 (Off-site Emission Reduction Fee Calculations and Fee Schedules) of the rule. <br /> As such, the District has determined that this project complies with the emission reduction <br /> requirements of District Rule 9510 and is not subject to payment of off-site fees. <br /> Pursuant to District Rule 9510, Section 8.4, the District is providing you with the following <br /> information: <br /> • A notification of AIA approval (this letter) <br /> • A statement of tentative rule compliance (this letter) <br /> • An approved Monitoring and Reporting Schedule <br /> • A copy of the Air Impact Assessment Application <br /> Certain emission mitigation measures proposed by the applicant may be subject to <br /> approval or enforcement by the County of San Joaquin. No provision of District Rule 9510 <br /> requires action on the part of the County of San Joaquin, however, please review the <br /> enclosed list of mitigation measures and notify the District if the proposed mitigation <br /> measures are inconsistent with your agency's requirements for this project.
