i <br /> I <br /> SECOND AMENDMENT TO AGREEMENT FOR ENVIRONMENTAL <br /> REMEDIATION ACTIVITIES <br /> This SECOND AMENDMENT TO AGREEMENT FOR ENVIRONMENTAL <br /> REMEDIATION ACTIVITIES ("Second Amendment to Agreement") is made and <br /> entered into on January j, 2016, between Pacific Gas and Electric Company, a <br /> California Corporation (hereafter"PG&E") and Lodi Iron Works (hereafter referred <br /> to as "Owner"), regarding Owner's property located at 820 S. Sacramento Street, <br /> Lodi, California (hereafter referred to as "Owner's Property"). <br /> It is understood between Owner and PG&E that: <br /> A. On or about July 2093, Owner and PG&E entered into a certain Agreement <br /> for Environmental Remediation Activities('Agreement'), under which <br /> Owner granted permission through September 30, 2014, to PG&E, <br /> including its employees, contractors, subcontractors and agents, to enter <br /> Owner's Property to conduct certain environmental remediation activities, <br /> which Agreement was modified by a First Amendment extending the <br /> duration of the Agreement through December 31, 2095; <br /> B. Owner and PG&E desire to further extend the duration of and modify the <br /> Agreement, as set forth below. <br /> Therefore, Owner and PG&E agree as follows: <br /> 1. Owner grants permission to PG&E, including its employees, contractors, <br /> subcontractors and agents, to enter Owner's Property to conduct <br /> environmental remediation activities described below on Owner's <br /> Property up to and ending on July 31, 2016, unless Owner and PG&E <br /> agree in writing to extend this Second Amendment to Agreement. <br /> 2. The above-referenced environmental remediation activities include <br /> marking the site for and conducting underground utility clearance, <br /> destroying two soil gas wells, and conducting other post-remediation <br /> activities. <br /> 3. Other than changing the duration of the Agreement and modifying the <br /> remediation activities as described above, the Agreement remains in full <br /> force and effect, and nothing in this Second Amendment to Agreement <br /> shall be deemed to alter or amend other terms of the Agreement. <br />
