CONDITIONS OF APPROVAL <br /> MS-98-40 <br /> Lagier <br /> Minor Subdivision Application No. MS-98-40 was approved by the San Joaquin County Community <br /> Development Department on December 24, 1998. The effective date of approval is January 3, 1999. <br /> This tentative map approval will expire on January 2, 2002, which is three years from the effective <br /> date of approval,unless(1)all Conditions of Approval have been complied with and (2)a Parcel Map <br /> has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified,and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: (Staff Contact: Jeff Fisher,468-9653) <br /> a. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) Parcel 1 shall have a minimum lot width of 150 feet. (Development Title Section 9- <br /> 610.2) <br /> (2) Parcel 2 shall have a minimum lot width of 330 feet. (Development Title Section 9- <br /> 610.2) <br /> (3) Parcel 1 shall have a minimum lot area of 2 acres and a maximum lot area of 5 <br /> acres. (Development Title Section 9-610.2) <br /> b. TRANSFER RESTRICTION: A Note shall be placed on the Parcel Map and a Notice of <br /> Minor Subdivision Restriction shall be recorded concurrently with the Parcel Map, with a <br /> reference to the instrument number of said recorded notice,stating that: <br /> (1) The homesite shall not be transferred separately until July 3, 2009, or upon <br /> the death of an owner owning at least fifty (50) percent interest in the <br /> homesite parcel. <br /> (2) The property shown on the Parcel Map is restricted from further <br /> subdivisions for homesite purposes,except for financing only, by Section 9- <br /> 610.3 of the San Joaquin County Development Title. <br /> C. FARM LABOR MOBILE HOMES: Upon any future sale of Parcel 2, one existing farm <br /> labor mobile home must be removed from Parcel 1. Also, the remaining farm labor mobile <br /> home must either be removed or be designated as a Second Unit Dwelling. The minimum <br /> lot area required for a farm labor mobile home is 20 acres (Development Title Section 9- <br /> 893.3[a]). A Second Unit Dwelling requires approval from the Community Development <br /> Department. <br /> 2. DEPARTMENT OF PUBLIC WORKS: (See the attached memo dated December 14, 1998.) <br /> 3. PUBLIC HEALTH SERVICES: (See the attached memo dated December9, 1998.) <br />
