CONDITIONS OF APPROVAL <br /> MS-98-23 <br /> Bender <br /> Minor Subdivision Application No. MS-98-23 was approved by the San Joaquin County <br /> Community Development Department on July 31, 1998. The effective date of approval is August <br /> 10, 1998. This tentative map approval will expire on August 9, 2001, which is three years from the <br /> effective date of approval, unless (1) all Conditions of Approval have been complied with and (2) <br /> a Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be <br /> fulfilled prior to approval of the Parcel Map. Those Conditions followed by a Section Number <br /> have been identified as Ordinance requirements pertinent to this application. Ordinance <br /> requirements cannot be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: (Staff Contact: Chandler Martin, 468-3144) <br /> a. APPROVED TENTATIVE MAP: This approval is for the tentative map submitted on June <br /> 19, 1998. A reduction of lot size was requested for Parcel 2 pursuant to the density bonus <br /> provisions of the Development Title. However, density bonus provisions are not required <br /> because Parcel 2 was an existing lot and was already below the minimum lot size of the RM <br /> zone. <br /> b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) Parcel 1 shall have a minimum lot width of 65 feet. (Development Title Section 9- <br /> 310.8) <br /> (2) Parcel 2 shall have a minimum lot width of 60 feet. (Development Title Section 9- <br /> 310.5) <br /> (3) Parcel 1 shall have a minimum lot area of 6000 square feet. (Development Title <br /> Section 9-310.3) <br /> (4) Parcel 2 shall have a minimum lot area of 5880 square feet. (Development Title <br /> Section 9-872.2[g]) <br /> C. LANDSCAPING: Landscaping shall be provided and comply with the following: <br /> (1) Street trees are required as specified in Section 9-1020.4 of the Development Title. <br /> 2. DEPARTMENT OF PUBLIC WORKS: (See the attached memo dated July 21, 1998.) <br /> 3. PUBLIC HEALTH SERVICES: (See the attached memo dated July 7, 1998.) <br /> 4. COUNTY COUNSEL: <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, <br /> the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, <br /> officers, and employees from any claim, action, or proceeding against the local agency or its <br /> agents, officers, or employees to attack, set aside, void, or annul an approval of the local <br /> agency, advisory agency, appeal board, or legislative body concerning a subdivision, which <br /> action is brought within the time provided for in Section 66499.37 of the Government Code. <br />
